For the purposes of this article, the following terms shall have the respective meanings ascribed to them:
Corner lot.
A lot or property located at the intersection or confluence of two or more streets such that public street rights-of-way are directly adjacent to at least two contiguous sides of the lot.
Driveway.
The continuous improved surface which provides ingress and egress from a garage, carport or off-street parking area to an adjacent street, alley or other improved public way.
Front yard.
A yard across the full width of a lot extending from the street to the largest required setback of either the required, established, platted building line or projected front yard. Setbacks shall be measured from the front property line. Each street frontage shall be considered a front yard except that in one- and two-family zoning districts, the extra frontage yards may be considered a side or rear yard if there are no other front yards projecting along that same block face.
Improved surface.
A continuous surface for the movement, parking or storage of a vehicle designed and constructed for all weather conditions including the use of gravel, paving blocks, asphalt, concrete or other materials as approved by the city engineer.
Large vehicle.
Any vehicle, towable device or combination thereof excluding recreational vehicles (RVs) that measures more than 25 feet in length or more than eight and one-half (8'-6") feet in height or that exceeds a manufacturer’s gross vehicle weight rating of 10,000 pounds.
Motor vehicle.
Any vehicle smaller than the defined large vehicle.
Old town (OT-Midlothian).
That portion of the city known as the original town of Midlothian plat areas and for the purposes of this article, generally described as the boundaries between 1st Street to North 14th Street and West Avenue A to Walter Stephenson Road, excluding the area around South 3rd, as depicted in the map below:

Park or parking.
The stopping, standing or permitting to stand of any vehicle, trailer or recreational vehicle whether attended or unattended, and whether with the motor running or not, except for the purpose of taking on and discharging passengers or freight.
Play vehicle.
Includes all forms of powered, wheeled transportation, including, but not limited to, roller skates, roller blades, skateboards, tricycles, scooters, play cars and pedal cars.
Rear yard.
An open unoccupied space, except for permitted accessory buildings, extending across the rear of the lot from one (1) side lot line to the other side lot line and having a depth between the main building and the rear lot line as prescribed for the zoning district in which the building is located.
Recreational vehicle.
(1) 
A vehicle primarily designed as temporary living quarters for recreational camping or travel use, including a travel trailer, camping trailer, truck camper, and motor home; or
(2) 
A boat, jet ski, or similar equipment with trailer.
Residential district.
Includes any zoning district that permits residential uses (including a planned development district as provided in the zoning ordinance) except for residential lots or tracts that are one (1) acre or more in area.
Side yard.
An open unoccupied space or spaces on one (1) or two (2) sides of a main building and on the same lot with the building situated between the building and a side line of the lot and extending from the front yard line to the rear yard line. Any lot line, not the rear line or front line, shall be deemed a side lot line.
Towable device.
A trailer or any other piece of equipment that is pulled by a motor vehicle.
Trailer.
A vehicle without means of motivation and designed to be towed, hauled or pulled by a motor vehicle.
Utility vehicle.
A vehicle designed and used primarily for utilitarian purposes including but not limited to a trailer, truck tractor, semitractor, dump truck, concrete mixing truck, construction equipment, tractor, farm machinery, boat trailer, truck bed mounted on a chassis, wheeled towing frame, utility trailer, boxed trailer, flat bed trailer, car carrier, panel truck or other similar vehicle including but not limited to tow truck, box truck, van or bus with a rated capacity of one and one-half tons.
Vehicle.
Any and every device upon or which a person or property is or may be transported, drawn or moved including but not limited to an automobile, motor vehicle, bus, truck, box truck, tractor, motor home or house, farm machinery, motorcycle, all-terrain vehicle, boat, boat trailer, aircraft, recreational vehicle, golf cart, trailer, semitrailer, semitractor trailer, camper, camper shell, wheeled towing frame, truck bed mounted on a chassis or similar devices.
Yard.
An open space other than a courtyard, on the same lot with a building, unoccupied and unobstructed from the ground upward. In measuring to determine the width of a side yard, the depth of the front yard or the depth of a rear yard, the least horizontal distance between the lot line and the main building shall be used.

(a) 
Parking spaces shall be designated, created and identified by appropriate signs, markers, paint stripes, other recognizable means, or as may be designated by the city council and are on file in the city secretary’s office.
(b) 
Any vehicle must be parked within the limits of such designated parking space.
(c) 
No vehicle may be parked within the front yard of a lot used for or intended to be used for residential purposes except as defined herein and on an improved surface.

No person shall stop, stand or park a vehicle, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic-control device, on a sidewalk or on any part of the sidewalk area, which area is hereby defined as the entire space between the curbline or the lateral line of a roadway and the adjacent property line along any street, irrespective of whether such area has been improved by concrete, gravel or other walkways. Any driveway existing prior to the passage of this article with less than 18 feet between the property line and the garage door or wall shall be exempted from this provision.

(a) 
Except as otherwise provided in this section it shall be unlawful for any person to park or store any vehicle on a lot less than 1 acre upon any surface other than an improved parking surface.
(b) 
Vehicular access to improved parking surface on a lot less than 1 acre shall be provided by means of a continuous full width, improved driveway surface unless the vehicle is stored behind the rear wall of the residence.
(c) 
The owner, occupant or person in control of any lot or tract on which an improved parking surface is located shall maintain such parking surface in good and safe condition free from holes, cracks or other defects in materials.

It shall be unlawful and an offense for any person to stand or park a vehicle on any public street, public right-of-way (ROW), public parking lot, public playground, athletic field, or public school for the principal purpose of displaying the vehicle for sale.

(a) 
Except as otherwise provided in section 12.03.009 it shall be unlawful for the owner, occupant or person in charge of property to park or store or permit the parking or storage of any vehicle on vacant or unimproved property of any residential lot or tract that is smaller than two (2) acres in area. In no instance shall parking be allowed within the required front yard of any residential lot.
(b) 
Except as otherwise provided in section 12.03.009 it shall be unlawful for the owner, occupant or person in charge of property within a residential district (lots less than 1 acre) to park or store or permit the parking or storage of any vehicle on improved property within the side yard except on an improved parking surface if parking surface is visible from a public street. Any vehicle parked within the side yard shall be screened from view by a fence six (6) feet in height or by a live screening wall that grows to a height of six (6) feet along the side yard property line running the length of the large vehicle and/or the towable vehicle.

(a) 
It is unlawful for any person or owner to leave, park or stand any large vehicle on any public street or street ROW for more than 48 continuous hours.
(b) 
The provisions of section 12.03.009 shall not apply to parking or standing of large vehicles for the purpose of expeditiously loading and unloading passengers, freight or merchandise, but not otherwise.
(c) 
It is unlawful to park a large vehicle or towable device within the side yard of any lot or tract within any residential lots or tracts less than 2 acres except on an improved parking surface screened from public view by a fence six (6) feet in height or by a live screening wall that grows to a height of six (6) feet along the side yard property line running the length of the large vehicle and/or the towable vehicle.
(d) 
It is unlawful to park a large vehicle or towable device on any public street or right-of-way within any residential district.
(e) 
For lots or tracts within OT-Midlothian occupied by or improved with a residential structure prior the date of adoption of this article, large vehicles and towable devices may be parked within the side or rear yard on a surface other than an improved parking surface. For any lots or tracts within OT-Midlothian for which a building permit is issued for the construction of a new residence or structure on such lot or tract after the date of adoption of this article, any large vehicle or towable device shall be parked on an approved parking surface screened from public view by a fence six (6) feet in height or by a live screening wall that grows to a height of six (6) feet along the side yard or rear property line, as the case may be, running the length of the large vehicle and/or the towable vehicle.

It shall be unlawful for any person or owner to leave, park or stand any recreational vehicle for a period not to exceed 72 hours within any 3-month period. This section shall not prevent the parking or standing of the above-described vehicles for the purpose of expeditiously loading and unloading passengers, freight or merchandise, but not otherwise.

It shall be unlawful to park or store or permit to park or store a large or utility vehicle, during the hours from sundown to sunup on private property except per section 12.03.007 above, except for the purpose of expeditiously loading or unloading passengers, freight or merchandise, or, used in conjunction with an approved construction project.

No vehicle, motor vehicle, towable device or large vehicle may be used for housekeeping, living, sleeping quarters, or for the storage of trash, debris or personal property not normally associated with the vehicle, except recreational vehicles which may be used as temporary living quarters for a period not to exceed 72 hours within any 3-month period.

The city’s public works director is authorized to erect signs on any sidewalk or roadway prohibiting the riding of bicycles and/or play vehicles by any person on such sidewalk or roadway. Whether such signs are in place or not, the operation of a bicycle and/or play vehicle on such area shall constitute an offense.

Whenever any person is riding a bicycle or play vehicle upon a sidewalk in a nonbusiness or noncommercial zoned area, such person shall yield the right-of-way to any pedestrian.

It shall be unlawful and an offense for any person to stop, stand, leave, or park any motor vehicle along any curb on the following streets during the specified times for the intended purpose of dropping off or picking up students attending school:
(1) 
Hyde Park Drive between Westminster Drive and Walnut Grove Road on official school days, including summer school days, from the hours of 3:30 p.m. and 4:30 p.m.
(2) 
Knights Bridge Lane between Westminster Drive and Walnut Grove on official school days, including summer school days, from the hours of 3:30 p.m. and 4:30 p.m.
(3) 
Branchwood Drive between the designated school zone limits on official school days, including summer school days, during the times when the designated school zone on said roadway is in effect.
(4) 
Meadow Glen Drive between Branchwood Drive and the designated school zone east of Branchwood Drive on official school days, including summer school days, during the times when the designated school zone on said roadway is in effect.
(5) 
Park Place Boulevard between Mockingbird Lane and St. James Place on official school days, including summer school days, during the times when the designated school zone on said roadway is in effect.
(6) 
Massey Meadows Way between Salvia Court and Walnut Grove Road on official school days, including summer school days, from the hours of 3:30 p.m. and 4:30 p.m.
(7) 
Indian Blanket Drive between Massey Meadows Way and Dandelion Lane on official school days, including summer school days, from the hours of 3:30 p.m. and 4:30 p.m.
(8) 
Larkspur Lane between Massey Meadows Way and Dandelion Lane on official school days, including summer school days, from the hours of 3:30 p.m. and 4:30 p.m.

(a) 
No parking, stopping, or standing at specific times.
(1) 
Regulating the parking, stopping, and standing of vehicles in a public roadway or right-of-way.
It shall be a violation of this section to park, stop, or stand a vehicle within the roadway or right-of-way of the following streets except for mechanical breakdown or emergency repairs:
(A) 
Pebble Creek - On south side of street from North 9th Street to Meadow Lane;
(B) 
Pebble Creek - On north side of street beginning from the center of the intersection of Pebble Creek and Meadow Lane to a point seventy-five feet (75') east.
(C) 
Meadow Lane - On both sides of street beginning from the center of the intersection of Pebble Creek and Meadow Lane to points seventy-five feet (75') in either direction (north and south).
(D) 
Meadow Lane - On both sides of street beginning from the center of the intersection of Westview Terrace and Meadow Lane to points seventy-five feet (75') in either direction (north and south).
(E) 
Westview Terrace - On both sides of street beginning from the center of the intersection of Westview Terrace and Meadow Lane to points seventy-five feet (75') in either direction (east and west) (except southwest corner).
(F) 
Rolling Hills - On both sides of street beginning from the center of the intersection of Westview Terrace and Rolling Hills to points seventy-five feet (75') south.
(2) 
Providing for the erection of signs within the right-of-way.
Signs shall be erected within the right-of-way of the streets set out above designating no parking, stopping, or standing.
(3) 
Effective times.
Weekdays, Monday through Friday, 4:00 p.m., to 9:00 p.m., and Weekends, Saturday and Sunday, twenty-four (24) hours.
(4) 
Penalty.
Any violation of the terms of this ordinance is declared to be a misdemeanor and any person found to be guilty thereof shall be punishable by a fine not to exceed $200.00. Each day that such violation continues shall constitute a separate offense and shall be punishable accordingly.
(b) 
No parking, stopping, or standing at any time.
(1) 
Regulating the parking stopping or standing of vehicles in and along a public roadway.
It shall be a violation of this subsection to park, stop, or stand a vehicle within the roadway or right-of-way of the following highway at any time:
(A) 
There shall be no parking, stopping, or standing of vehicles on either side of the roadway along U.S. Highway 287 from S. Clinton Lane to Rex Odom Drive (both directions), in the city.
(B) 
There shall be no parking, stopping, or standing of vehicles on either side of the roadway along the U.S. Highway 67 access roads from U.S. Highway 287 north to Shiloh Road, in the city.
(C) 
There shall be no parking, stopping, or standing of vehicles on either side of the roadway along Main Street (U.S. Highway 287 Business) from Midlothian Parkway westward to U.S. Highway 287 (both directions), in the city.
(D) 
There shall be no parking, stopping, or standing of vehicles along FM 663 (South 9th Street) from George Hopper Road southward to U.S. Highway 287 (east side only), in the city.
(E) 
On FM 663 from McAlpin Road northward to Tower Road (east side only), in the city.
(F) 
Robinson Road (both sides) from US Highway 287 to Eastgate Road.
(G) 
Hillstone Drive inside each of the three (3) traffic circles located between F.M. 663 and South 14th Street.
(H) 
Ledgestone Lane at the arch span bridge crossing located south of Sunbeam Lane.
(2) 
Authorize erection of appropriate signs.
The city manager or their designee is hereby authorized to cause to be erected, appropriate signs designating no parking, stopping or standing at any time.
(3) 
Penalty.
Any person violating any of the provisions of this subsection shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any amount not to exceed five hundred dollars ($500.00), and each occurrence that such violation continues shall constitute a separate offense and shall be punishable accordingly.
