A. 
This is a resolution to create an ordinance of Nockamixon Township in relation to water conservation performance standards for plumbing fixtures and fittings.
B. 
The installation of water-saving plumbing fixtures and fittings can save substantial quantities of water; about 2/3 of the interior residential use of water is for water closet (toilet) flushing and bathing and, in many cases, use of water-saving fixtures and fittings can cut this use in half.
C. 
A number of national associations have endorsed the use of water-saving fixtures and fittings; both the Building Officials and Code Administrators International (BOCA) and the National Association of Plumbing-Heating-Cooling Contractors incorporate principles that embody water conservation in their model plumbing codes.
D. 
The Nockamixon Township Board of Supervisors recognizes the benefits associated with the use of water-saving fixtures and fittings and hereby adopts the following set of water conservation performance standards for plumbing fixtures and fittings that would apply in Nockamixon Township.
All water conservation performance standards for plumbing fixtures and fittings shall comply with the following minimum standards:
A. 
For sink and lavatory faucets, maximum flow shall not exceed three gallons of water per minute when tested in accordance with American National Standard Institute (ANSI). A112.18.1M.
B. 
For shower heads, maximum flow shall not exceed three gallons of water per minute when tested in accordance with ANSI A112.18.1M.
C. 
For water closets and associated flushing mechanisms, maximum volume shall not exceed 1.6 gallons of water when tested in accordance with the hydraulic performance requirements of ANSI A112.19.2M or ANSI A112.19.6M.

D. 
For urinals and associated flushing mechanism, maximum flow shall not exceed 1 1/2 gallons of water per flush when tested in accordance with the hydraulic performance requirements of ANSI A112.19.6M.
A. 
The performance standards of § 222-2 shall apply to plumbing fixtures and fittings installed in new construction and in existing structures undergoing renovations involving replacement of such fixtures and fittings.
B. 
The performance standards of § 222-2 shall not apply to fixtures and fittings such as emergency showers, aspirator faucets and blowout fixtures that, in order to perform a specialized function, cannot meet the standards specified in § 222-2.
Any person who violates or permits a violation of this chapter shall, upon conviction in a summary proceeding brought before a District Justice under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be punishable by a fine of not more than $1,000, plus costs of prosecution. In default of payment thereof, the defendant may be sentenced to imprisonment for a term not exceeding 30 days. Each day or portion thereof that such violation continues or is permitted to continue shall constitute a separate offense, and each section of this chapter that is violated shall also constitute a separate offense.

When the Township, PaDEP or DRBC declare(s) a water shortage, the following water uses are declared nonessential and are prohibited within Nockamixon Township:
A. 
Watering of lawns.
B. 
Watering of outdoor gardens, landscaped areas, trees, shrubs, and other outdoor plants, except between the hours of 5:00 p.m. and 9:00 a.m. by means of a bucket or pail at the minimum rate necessary.
C. 
Washing of automobiles and trucks except when required for safety and operational purposes.
D. 
Washing of streets, driveways, and sidewalks.
E. 
Ornamental water use, including, but not limited to, fountains, artificial waterfalls, and reflecting pools.
F. 
Use of water for flushing sewers or hydrants by any public or private individual or entity except as deemed necessary and approved in the interest of public health or safety by health officials or the Board of Supervisors.
G. 
Use of fire hydrants by fire companies for testing fire apparatus and for fire drills except as deemed necessary in the interest of public safety and specifically approved by the Township.
H. 
Use of fire hydrants by municipal road departments, contractors, and all others except as necessary for firefighting or protection purposes.
I. 
The use of water to fill and top off swimming pools.

A. 
Water saving fixtures and devices shall be required in all new construction regardless of public or private water supply in accord with the current unified building code regulations.
B. 
Initial filling of new swimming pools shall be completed from a source other than an on-site well.
