Chapter 284 Smoking and Vaping

§ 284-1 Definitions.

As used in this chapter, the following words, unless the context clearly requires otherwise, shall have the following meanings:

PUBLIC BUILDING

Any enclosed, indoor area located in a building owned or occupied by any department or agency of the commonwealth, or any political subdivision thereof, including the Town.

SCHOOL PROPERTY

Any land, public building, trailer, or motor vehicle owned or occupied by the Town School Department.

SMOKING

The lighting of any cigar, cigarette, pipe or other tobacco or marijuana or nicotine product or of a device that heats up and vaporizes a liquid or solid tobacco, marijuana or nicotine product, including but not limited to e-cigarettes, vape pens or similar products, or having possession of any such lighted product.

§ 284-2 Smoking prohibited on school property.

Smoking, as that term is defined herein, within school buildings, the school facilities, or on school grounds by any individual, including school personnel, is prohibited.

§ 284-3 Public buildings.

No person shall smoke in any public building in the Town.

§ 284-4 Violations and penalties.

Any person who violates any provision in this by-law shall be punished by a fine as follows:

First offense: warning.

(2)

Second offense: $25.

(3)

Third and subsequent offense: $50.

Subsequent offenses shall be determined as offenses occurring within two years of the date of the first noticed offense. Each day or portion thereof shall constitute a separate offense. If more than one, each condition violated shall constitute a separate offense.
