A. Purpose. The purpose of this article is to establish a policy and
procedures for the removal of fallen trees on public property, infrastructure,
and rights-of-way.
B. Applicability. This article applies to all properties located within
Schwenksville Borough.
C. Responsibility of Borough Manager. The Borough Manager will have
the responsibility for overseeing and implementing the policy and
procedures set forth herein.
D. Policy. When fallen trees within the Borough block access to any
public property, infrastructure, or rights-of-way, the following policy
and procedures set forth herein shall apply.
A. When the Borough is made aware of a fallen tree or branch on public
property, infrastructure or right-of-way, the Borough will use all
readily available means to contact the owner of the tree or branch
to expedite removal.
B. If the fallen tree or branch is blocking traffic, the property owner
must remove the offending tree or branch within two hours of notification.
If the fallen tree or branch is located on public property without
blocking traffic, the property owner must remove the offending tree
or branch within 72 hours.
C. If the fallen tree or branch is not removed within after notification
of the property owner, or if the Borough is unable to successful notify
the property owner after the Borough attempts to do so, the Borough
will contract to have the tree or branch removed and any costs incurred
to the Borough will be invoiced to the owner of the fallen tree or
branch. The Borough will take all reasonable measures to keep costs
to the property owner minimized.
D. All invoices for removal shall be paid by the property owner within
30 days of mailing unless alternative payment arrangements are made
with the Borough.
E. A person who violates this provision is guilty of a separate offense
for each day or part of a day during which the violation is committed,
continued, or permitted. An offense is punishable by a maximum fine
of $1,000.
