Those citizens who resided within the Town on January 2, 1968, and who did not subscribe to or make application for connection to the public sewer may continue to use their existing sewage disposal system provided it meets with the requirements of the Department of Health of the state; provided, further, that if such houses, buildings or other properties used by humans for occupancy, employment, recreation or other purposes, which presently have private sewage disposal systems as provided in this section, become unoccupied, and such system, whether water or sewer, or both, is determined by the Public Works Department to be inadequate and unhealthy, connection to public sewer and water systems shall be required as provided in § 177-10 in respect to hook up to public sewer and Chapter 210, Water, in respect to hook up to public water.

Where the public sewer system is not available, inaccessible or not in the vicinity of a prospective user, the building sewer shall be connected to a private sewage disposal system built in accordance with and under the supervision of the Department of Health of the state.

At such time as a public sewer becomes available to a property served by a private system and the department of health of the state finds the private system inadequate, a direct connection to the public sewer shall be made in compliance with this chapter and the private system abandoned within 90 days of official notice from the State Health Department. The abandoned private system of whatever nature shall be filled with suitable material as recommended by the Department of Health. All costs incurred under this section shall be borne by the property owner except as shown under § 177-3. Deposits, service charges and cost of service shall be outlined under § 177-3.
