Those citizens who resided within the Town on January 2, 1968, and who did not subscribe to or make application for connection to the public sewer may continue to use their existing sewage disposal system provided it meets with the requirements of the Department of Health of the state; provided, further, that if such houses, buildings or other properties used by humans for occupancy, employment, recreation or other purposes, which presently have private sewage disposal systems as provided in this section, become unoccupied, and such system, whether water or sewer, or both, is determined by the Public Works Department to be inadequate and unhealthy, connection to public sewer and water systems shall be required as provided in § 177-10 in respect to hook up to public sewer and Chapter 210, Water, in respect to hook up to public water.
