[Amended at time of adoption of Code (see Ch. 1, General Provisions, Art. IV)]
No fence may be erected within a residential, commercial or industrial district which does not comply with the following specifications:
A. 
Any fence erected in a required front yard shall be at least 50% open, and no fence erected in a required front yard may exceed five feet in height measured from ground level. A clearance of three inches shall be allowed for installation purposes and shall not count in determining the height of a fence. No privacy fence may be erected in the front of a residence. For through lots, that yard which is used as a rear yard, and which would normally be considered a rear yard for lots other than through lots, shall be considered a rear yard for purposes of erecting a fence. (See also § 245-19 of the Dwight Municipal Code.)
B. 
Any fence on an interior side or rear yard may be placed on the property line.
C. 
No fence may be erected which exceeds six feet in height above ground level in a residential area. In commercial and industrial areas, no fence may be erected which exceeds eight feet in height.
D. 
No fence may be constructed with barbed wire, metal spikes, or any other sharp pointed materials. All chain link fences shall be installed with the knuckle portion of the fence up and with the barb portion of the fence at or near the ground. No fence may be electrified.
E. 
All areas of a lot on the exterior side of the fence, including the fence itself, are to be maintained by the property owner.
F. 
The finished side of all fences shall face outward from the property on which the fence is being erected.
G. 
Electrified fences are prohibited.
Fences erected for purposed of providing fencing around sports or recreation facilities or areas as listed below shall not be subject to the height restrictions specified elsewhere in this section. The maximum height of a fence is listed by each sports or recreational facility or area as follows:

A. 
Every person owning land on which there is situated a swimming pool or other man-made body of water, which contains 24 inches or more of water in depth at any point, shall erect and maintain thereon, an adequate enclosure, either surrounding the property or pool area, sufficient to make such body of water inaccessible to small children. Such enclosure, including gates therein, shall be not less than four feet above the underlying ground and shall comply with the maximum height restrictions listed elsewhere in this section. All gates shall be self-closing and self-latching with latches placed four feet above the underlying ground and otherwise made inaccessible from the outside to small children.
B. 
A protective device approved the Village Administrator shall be an acceptable enclosure so long as the degree of protection afforded by the substituted devices or structures is not less than the protection afforded by the enclosure.
