As used in this chapter, the following terms shall have the meanings indicated:
ALTERNATE NICOTINE PRODUCT
Any product or device not consisting of or containing tobacco that provides for the ingestion into the body of nicotine, whether by chewing, smoking, absorbing, dissolving, inhaling, snorting, sniffing, or by any other means. Alternate Nicotine Product does not include any product approved by the United States Food and Drug Administration for sale as a tobacco cessation product, as a tobacco dependence product, or for other medical purposes, and is being marked and sold solely for that approved purpose.
SMOKELESS TOBACCO
Any tobacco products that are suitable for dipping or chewing.
TOBACCO ACCESSORIES
Cigarette papers, pipes, holders of smoking materials of all types, cigarette rolling machines, and other items, designed primarily for the smoking or ingestion of tobacco products or of substances made illegal under any statute or of substances whose sale, gift, barter, or exchange is made unlawful under this chapter.
TOBACCO PRODUCTS
Cigars, cigarettes, smokeless tobacco, or tobacco in any of its forms.

A. 
No person shall sell, give away, barter, exchange, or otherwise furnish any tobacco products, tobacco product samples, tobacco accessories and/or alternate nicotine products to any individual under 21 years of age.
B. 
No person shall sell, buy for, distribute samples of or furnish any cigar, cigarette, smokeless tobacco in any of its form or alternate nicotine product, to any minor under 21 years of age.
C. 
Any person violating any provision of this chapter shall, upon a conviction thereof, be subject to a fine as designated in the fine rate schedule for each offense.
A. 
It shall be unlawful for any person under the age of 21 years of age to purchase tobacco products and/or alternate nicotine products or to misrepresent their identity or age, or the use of any false or altered identification for the purpose of purchasing tobacco products and/or alternate nicotine products.
B. 
Any person under the age of 21 years of age violating any provision of this chapter shall, upon a conviction there of, be subject to a fine as designated in the fine rate schedule for each offense.
A. 
It shall be unlawful for any person under the age of 21 years of age to possess any tobacco products and/or alternate nicotine products; provided that the possession by a person under the age of 21 years of age is under the direct supervision of the parent or guardian of such person in the privacy of the parent or guardian's home shall not be prohibited.
B. 
No parent, guardian or caretaker shall permit, allow or facilitate, actively or passively, a child for whom they are responsible under 21 years of age to purchase, possess or consume in any manner or form any cigarettes or electronic cigarette or alternate nicotine product or tobacco product other than as described above.
C. 
Any person under the age of 21 year of age violating any provision of this chapter shall, upon a conviction there of, shall be subject to a fine as designated in the fine rate schedule for each offense.
A. 
Every Vendor selling any tobacco, tobacco related items, and/or alternate nicotine products shall be required to post a sign in each location conspicuously placed stating the following:
"The sale of Tobacco, Tobacco accessories, smoking herbs, and/or alternate nicotine products to persons under the age of 21 is prohibited."
B. 
Any vendor violating this provision shall be subject to a fine as designated in the fine rate schedule for each offense.
