There is created and established in the city the parks and recreation
department, sometimes referred to in this chapter as the "department."
The department shall be responsible for and shall promote and carry
on recreational activities sponsored or conducted by the city. The
department shall have delegated responsibility for all public parks
of the city as well as for Harry Della Russo Stadium.

Upon the effective date of the ordinance from which this chapter
derives, the director and all employees of the youth commission of
the city shall be transferred to the parks and recreation department
without impairment of seniority, retirement rights or other rights,
and without reduction in compensation or salary grade. Civil service
status of the director and such employees shall be preserved.

The parks and recreation department shall be under the general
supervision of a director, referred to in this chapter as the "director,"
who shall be appointed by the mayor, subject to the provisions of
Chapter 31 of the General Laws.

The director of the parks and recreation department shall have full charge of the department and shall be responsible for all recreation programs sponsored or conducted by the city. The director may also have delegated responsibility for all public reservations which are owned or controlled by the city, as of or after the effective date of the ordinance from which this article is derived, and which are or may be used or known as parks, commons or playgrounds. Such delegated responsibility shall be in accordance with Section
2.57.010. The director shall also have delegated responsibility over that certain parcel of land known as Harry Della Russo Stadium.

There is created and established in the city a commission to
be known as the parks and recreation commission, sometimes referred
to in this chapter as the "commission."

The parks and recreation commission shall consist of five members
appointed by the mayor and subject to confirmation by the city council.
At least two of such members shall be women, and one member shall
be a representative of the youths of our city between the ages of
seventeen and twenty years. The terms of the commission members shall
be coterminous with that of the mayor.

A. It shall
be the duty of the parks and recreation commission to manage, direct,
equip and care for the parks and playgrounds and of the planting and
care of trees and shrubs therein and the conduct and use thereof.
B. Upon
the effective date of the ordinance from which this chapter derives,
the commission shall have the jurisdiction and control of the athletic
field in Harry Della Russo Stadium provided for in Chapter 31 of the
Acts and Resolves of the 1927 Massachusetts Legislature and Chapter
90 of the Acts and Resolves of the 1965 Massachusetts Legislature.
The parks and recreation commission shall exercise the powers conferred
by Chapter 45, Section 14 of the General Laws upon the municipality
with reference to the use and control of the playgrounds.
C. The commission may delegate the execution of the duties mentioned in subsections
A and
B of this section to the department of parks and recreation.
D. The
commission shall have advisory powers in relation to all recreational
activities proposed and sponsored or conducted by the parks and recreation
department.

There shall also be in the parks and recreation department a
labor force to consist of such personnel as may be appointed by the
mayor and provided for by the city council.
