This chapter and inclusive sections shall be known as the "Bicycle Ordinance." Its purpose is to regulate the use and storage of bicycles upon the ways and walks of the city; to provide a uniform procedure under which the city may take custody of abandoned bicycles; to provide a uniform procedure for the retrieval of abandoned bicycles taken by the city; and to distinguish bicycles from other two or three-wheeled vehicles.

"Bicycle":
A vehicle consisting of a frame and two tandem wheels that is propelled exclusively by human power applied to pedals connected to a rear wheel by a chain, and utilizing handlebars for steering and a seat for its rider. No operator of a bicycle shall be required to possess a driver's license and no bicycle is required to be registered with the Massachusetts Registry of Motor Vehicles.
"Bicycle parking facility":
Any facility for the temporary storage of bicycles that allows the frame and one or both wheels to be locked so as to minimize the risk of theft and vandalism.
"Bicycle-share business":
A person or company in the business of providing or otherwise making available shared bicycles for hire. For the purposes of this chapter, a bicycle-share business shall be deemed the owner of any such bicycle associated with, provided, or otherwise made available by such bicycle-share business.
"Bicycle-share customer":
Any person who rents, hires, or uses a shared bicycle.
"Motorized bicycle":
A bicycle that can be propelled by a helper motor; or a pedal or non-pedal bicycle which has a motor with a cylinder capacity not exceeding fifty cubic centimeters, an automatic transmission, and which is capable of a maximum speed of no more than thirty miles per hour and subject to the requirements set forth in Chapter 90 Sections 1B through 1D of the Massachusetts General Laws. A motorized bicycle shall be registered with the Massachusetts Registry of Motor Vehicles, shall be subject to all Massachusetts traffic laws and regulations, and shall not be operated at a speed greater than twenty-five miles per hour. An operator of a motorized bicycle must be at least sixteen years of age and possess either a valid Massachusetts learner's permit or drivers license.
"Shared bicycle":
A bicycle that is owned by a bicycle share business that is made available to persons for renting on a self-service basis. A shared bicycle shall not be a motorized bicycle, motorized scooter, motorcycle, low-speed motor vehicle or limited-use motor vehicle all as defined and/or governed in Sections 1 through 1E, inclusive, of Massachusetts General Laws Chapter 90.

A. 
Bicycles may be parked free standing and locked against a public building, street sign pole, parking meter, and on or against a bicycle rack, or parked at any location or facilities designated for bicycle parking.
B. 
No bicycle shall be parked in a manner that causes the bicycle to obstruct any sidewalk, public way or handicap access ramps. Bicycles shall be parked as near to either edge of a sidewalk as is practical, but must be parked in every case so to leave a minimum of thirty-six inches of unobstructed passage on a sidewalk.
C. 
No bicycle shall be parked or secured to a fire hydrant, public hand railing or bench, public shade trees, trash receptacles, or in any restricted area as posted.

A. 
No less than twenty-four hours after a bicycle is reported to the city as parked and unattended at one location upon a public sidewalk or street, the city will attempt to identify and contact the owner of the bicycle, and in the case of an unattended shared bicycle contact the bicycle-share business associated with the bicycle, and notify the owner that the bicycle has been reported as parked and unattended, and direct the owner or business to remove the bicycle.
B. 
No less than seventy-two hours after providing such notice to the owner as provided in Subsection (A), and if the bicycle remains parked and unattended, the bicycle shall be deemed abandoned and subject to removal by the CITY of Revere police department or department of public works.
C. 
An abandoned bicycle removed by the city shall be held not less than thirty days, and during such time the bicycle is held by the city it may be reclaimed by the owner in accordance with the provisions of Section 8.07.060.
D. 
An abandoned bicycle that has been held by the city at least thirty days and that has not been reclaimed by the owner during such time may be discarded by the city at its discretion.
E. 
In no case shall the city of Revere be responsible for any damage to the bicycle that occurs during the removal, storage, or discard of the bicycle.

A. 
All abandoned bicycles removed by the city shall be stored, and may be reclaimed, from the city of Revere department of public works, located at 321 Charger Street, Revere Massachusetts 02151.
B. 
The owner of an abandoned bicycle removed by the city of Revere, shall be fined fifty dollars for each bicycle removed and stored by the city of Revere.
C. 
The owner of an abandoned bicycle may reclaim the bicycle by presenting to the city proper identification, proof of ownership of the bicycle, and proof of payment of such fine with a receipt issued by and bearing the stamp of the city of Revere treasurer's office. Proof of ownership can include receipt of bike registration from the Revere police department and or receipt of purchase of the said bike with matching serial number.
