A. 
No person, having possession, custody or control of any animal, shall knowingly or negligently permit any dog or other animal to commit any nuisance, i.e., defecation or urination, upon any gutter, street, driveway, alley, curb, or sidewalk in the Borough; upon the floors or stairways of any building or place frequented by the public or used in common by the tenants; upon the outside walls, walkways, driveways, alleys, curbs or stairways of any building abutting a public street or park; upon the grounds of any public park, playground, recreation area, or public area; or upon any private property without the consent of the property owner other than the property of the owner of such animal.
B. 
Any person having possession, custody or control of any dog or other animal which commits a nuisance, i.e., defecation or urination, in any property other than the private property of the owner of such animal, as prohibited in Subsection A of § 118-12, shall be required to immediately remove any feces from such surface and either carry same away for proper disposal or place same in a non-leaking container for deposit in a trash or litter receptacle.
C. 
These provisions shall not apply to a guide dog accompanying and assisting any blind, deaf, or physically handicapped person.

No person, having possession, custody or control of any animal, shall knowingly or negligently permit any dog or other animal to commit nuisance, interference, or harm while on any public property, public right-of-way, street, alley, curb, or sidewalk in the Borough; upon the floors or stairways of any building or place frequented by the public or used in common by the tenants; upon the outside walls, walkways, driveways, alleys, curbs or stairways of any building abutting a public street or park; upon the grounds of any public park, playground, recreation area, or public area; or, upon any private property without the consent of the property owner other than the property of the owner of such animal.
B. 
Any person having possession, custody or control of any dog or other animal while on any property other than the private property of the owner of such animal, as prohibited in Subsection A of § 118-13, shall be required to immediately bring their animal under control.
C. 
Whenever any other person or animal is present in any public place or in any open or unfenced area bordering a public place, a person who owns, possesses or controls a dog or other animal shall not permit it to be in that public place or any open or unfenced area bordering a public place unless the dog or animal is effectively restrained by a leash or chain not more than six feet long or extendable to more than six feet in length.
D. 
It is unlawful for an owner or keeper of a uncontrollable or dangerous dog or animal to permit the animal to be outside a proper enclosure unless the animal is muzzled and restrained by a substantial chain or leash and under physical restraint of a responsible person.
E. 
These provisions shall not apply to a certified and specially trained guide dog accompanying and assisting any blind, deaf, physically handicapped or disabled person, who has their dog under proper control.
F. 
These provisions shall not apply to any special event involving dogs or animals where the organizer has filed an application with, and received approval from, the Borough to hold such event on public property or an open or unfenced area bordering a public property.

Any person, firm, or corporation who shall violate any provision of § 118-12 or 118-13 of this article shall, upon being found liable therefor, pay a fine of not more than $600, plus court costs and reasonable attorneys' fees incurred by the Borough in the enforcement proceedings. If the penalty is not paid, the Borough shall initiate a civil action for collection in accordance with the Pennsylvania Rules of Civil Procedure. Each day a violation exists shall constitute a separate offense, and each section of this article that is violated shall also constitute a separate offense. In addition to or in lieu of enforcement under this section, the Borough may enforce this article in equity in the Court of Common Pleas of Bucks County.
If any section of provision of this article shall be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of this article as a whole or any part thereof other than that portion specifically declared invalid.
