As used in this chapter, the following terms shall have the meanings indicated:
WEEDS
All grass, plant life or vegetation whatsoever, which is not edible or is not planted for some useful or ornamental purpose or which throws off any unpleasant or noxious odor, which conceals any filthy deposits, or tends to create or produce pollen. This term shall not include trees, hedges, shrubs, Canada thistles, Cichorium intybus (commonly known as "chickory" or "succory" or "blue daisy"), or marijuana.
No person or persons, firm or firms, association or associations, partnership or copartnerships, corporation or corporations owning or occupying any property within the Borough of Langhorne shall permit any weeds to grow or remain upon such premises within 200 feet of any residential dwelling so as to exceed the height of 12 inches. Any weeds so growing upon any premises in the Borough of Langhorne or which in any other means violates any of the provisions of this chapter is hereby declared to be a nuisance and detrimental to the health, safety, cleanliness, comfort and welfare of the inhabitants of Borough.
The owner of any premises, as to vacate premises, or premises occupied by the owner, or the occupant thereof, in case of premises occupied by other than the owner thereof, shall remove, trim or cut all weeds growing or remaining upon such premises in violation of the provisions of this chapter.
The Borough Council, or any officer or employee of the Borough designated thereby for the purpose, is hereby authorized to give notice, by personal service or by United States mail, to the owner or occupant, as the case may be, of any premises whereon weeds are growing or remaining in violation of the provisions of this chapter, directing and requiring such occupant to remove, trim or cut such weeds, so as to conform to the requirements of this chapter, within five days after issuance of such notice. In case any person or persons, firm or firms, association or associations, partnership or copartnerships, corporation or corporations shall neglect, fail or refuse to comply with such notice within the period of time stated therein, the Borough authorities may remove, trim or cut such weeds and the cost thereof, together with any additional penalty authorized by the law, may be collected by the Borough from such person or persons, firm or firms, association or associations, partnership or copartnership, corporation or corporations in the manner provided by law.
Any person or persons, firm or firms, association or associations, partnership or copartnerships, corporation or corporations who or which shall violate or fail, neglect to refuse to comply with any of the provisions of this chapter shall, upon conviction thereof, be sentenced to pay a fine of not more than $100 and costs of prosecution; provided, each day's violation shall constitute a separate offense and notice to the offender shall not be necessary in order to constitute an offense. Upon judgment against any person being entered and upon default in the payment of the fine and costs, the defendant may be sentenced and committed for a period not to exceed 30 days.
The provisions of this chapter are severable and if any word, words, part, parts, provision, section, sentence, clause, exception or exemption shall be declared illegal, invalid or unconstitutional by a Court of competent jurisdiction, such illegality, invalidity or unconstitutionality shall not affect or impair any of the remaining words, parts, provisions, sections, sentences, clauses, exceptions or exemptions of this chapter. It is hereby declared to be the intent of the Council that this chapter would have been adopted if such illegal, invalid or unconstitutional word, words, part, parts, provisions, section, sentences, clauses, exceptions or exemptions had not been included herein.
