All land owned or leased by the Borough for park or recreation purposes shall be subject to the rules and regulations herein set forth. Such rules and regulations shall apply to any natural person, firm, copartnership, association or corporation, and the term "person" as hereinafter used shall apply to any and all groups just mentioned.
The following rules and regulations are hereby established for the management and protection of the parks and recreation areas owned or leased by the Borough.
A. 
The parks and playgrounds shall be open daily to the public during the hours posted, and not thereafter. No person, other than authorized employees of the Borough, shall remain in any park or playground after the same is closed, and before the same is open again in the morning, unless permission is granted by the authority having jurisdiction over the said park or recreation area.
B. 
The following enumerated actions or conduct on the part of any person in any park or recreation area are prohibited:
(1) 
Building any fire anywhere except at locations provided for such purpose, to leave any fire unattended, or to fail to extinguish any fire before leaving it.
(2) 
Selling, distributing or consuming any intoxicating beverages.
(3) 
Entering or going into any park or recreation area when under the influence of intoxicating liquor or any narcotic drug or habit-forming drug.
(4) 
Gambling.
(5) 
Doing, performing or partaking in any obscene or indecent act or actions.
(6) 
Using any abusive, indecent, obscene or threatening language.
(7) 
Doing, performing or partaking in any type of conduct which by its nature would annoy or disturb any reasonable person or group of persons lawfully using the park or recreation area.
(8) 
Scattering, dropping or leaving in any portion of a park or recreation area, except in receptacles provided for the purpose, any pieces of paper, rags, garbage, glass, tin containers or other rubbish.
(9) 
Marking, defacing, damaging or destroying any building, poster, sign, park or recreation property, or any other property of the Borough, in any manner whatsoever.
(10) 
Cutting, mutilating or removing or destroying in any manner whatsoever any trees, shrubbery, flowers, seeds, plants or wood, except upon proper authorization by Borough Council.
(11) 
Using, operating or parking any motorized vehicle in any park or recreation area, except in areas specially designated for parking.

Any person violating any of the provisions of this article shall, upon being found liable therefor, pay a fine of not more than $600, plus court costs and reasonable attorneys' fees incurred by the Borough in the enforcement proceedings. If the penalty is not paid, the Borough shall initiate a civil action for collection in accordance with the Pennsylvania Rules of Civil Procedure. Each day a violation exists shall constitute a separate offense, and each section of this article that is violated shall also constitute a separate offense. In addition to or in lieu of enforcement under this section, the Borough may enforce this article in equity in the Court of Common Pleas of Bucks County.
