This chapter shall be known as the "Millvale Borough Enforcement Ordinance."

This chapter shall regulate the process of permits in the Borough of Millvale. Any structure as defined by the Borough of Millvale Code and Pennsylvania Uniform Construction Code shall not be erected without first obtaining some form of permit unless documented by the Borough of Millvale.
The permitting process, applications, administration, and enforcement shall be in accordance with the Borough Code. All applications must be submitted to the Borough. The permitting process will vary depending on the scope of work and Borough Code requirements. The scope of the work and Borough Code will determine what application needs to be submitted for review.
The issuance of permits shall vary based on the scope of work and whether it follows the Borough Code. All permits will be reviewed and processed by the proper authority laid out in the Borough Code. Fees are listed on a Fee Schedule created by the Borough of Millvale.
No permit shall be issued to any applicant if said applicant is delinquent in payments to the Borough Payments owed to the Borough are determined by fees set forth in the Borough Code or within the Borough Fee Schedule.
When a property within the Borough limits fails to file for the proper permit set forth in the Borough Code, in that case, the Borough Manager or designee has the right to notify the property owner by written notice served to the property owner personally, by U.S. Mail to the property owner's last known address, by leaving or affixing the notice to the property where the violation exists and/or issuing a stop-work/cease-and-desist order. The notice shall state the reason for the violation and the conditions under which the cited work or use is authorized to resume. The property owner will have 10 days to file for the proper permits for the scope of work. If the property owner fails to file for the proper permits within 10 days, then that person will be cited by the Borough. If the person begins the permitting process within the ten-day notice term, then the violation and/or the stop-work/cease-and-desist order is put on hold. Once the permit has been processed and reviewed, the person will be notified and will have 10 days to pay the permit fee/fees or remedy any issue/issues discovered during the review process. If the permit fee/fees are not paid within 10 days, the previous violation will result in a citation. If the person does not satisfy the violation in the proper amount of time, then the scope of work shall be considered void, and the property owner must immediately remove the scope of work.
The following sections shall apply unless another Borough of Millvale Code chapter or ordinance specifies differently.
The Borough Manager or designee is authorized to issue a stop-work order/cease-and-desist order to any person within Borough limits in violation of the Borough Code.
A stop-work order/cease-and-desist order shall be in writing and shall be sent to the owner of the property and posted on the property in a visible place. Upon issuance of a stop-work order/cease-and-desist order, the cited work or use shall immediately cease. The stop-work order/cease-and-desist order shall state the reason for the order and the conditions under which the cited work or use is authorized to resume.
The Borough Manager or designee shall promptly notify the police of the issuance of every stop-work order/cease-and-desist order. The police, upon the request of the Borough Manager or designee, shall render assistance in the enforcement of any stop-work order/cease-and-desist order and shall have the right to enter the premises for such purpose and to arrest anyone violating any stop-work order/cease-and-desist order as provided in this chapter.
The Borough shall have the right to revoke any previously issued permits. Revoked permits shall not be reinstated except upon compliance with the terms of the stop-work order/cease-and-desist order and payment of required fees.
It shall be a violation of this chapter for any person to:
A.
Continue any work in or around any structure or premises or entering any structure or premises, after a stop-work order/cease-and-desist order has been issued, except when correcting the stop-work order/cease and desist order.
B.
Continue use of the property on which a stop-work order/cease-and-desist order has been posted.
C.
Remove, damage, alter, or deface any stop-work order/cease-and-desist order.
D.
Interfere with any Borough official in the performance of their duties enforcing the Borough Code.
