(a) 
Pursuant to Section 11.38 of the Texas Alcoholic Beverage Code, the city council of the City of Irving hereby establishes a fee for each permit issued by the Texas Alcoholic Beverage Commission for each premises located within the City of Irving.
(b) 
The amount of the fee shall be one-half (½) of the state fee, and shall be paid annually upon renewal of the Texas Alcoholic Beverage Commission permit.
(c) 
This fee shall not apply to those permits specifically excepted from this fee by the Texas Alcoholic Beverage Code including but not limited to mixed beverage permits during the three-year period following the issuance of the mixed beverage permit and private club registration permits.
(d) 
Upon failure to pay the fee required by this section, the city attorney may notify the Texas Alcoholic Beverage Commission of such failure for cancellation of the Texas Alcoholic Beverage Commission permit.
(e) 
It shall be unlawful for a permittee of the Texas Alcoholic Beverage Commission to sell an alcoholic beverage without payment of the fee required by this section. Each individual beverage sale shall constitute a separate offense, the punishment for which shall be not less than ten dollars ($10.00) nor more than five hundred dollars ($500.00).
(f) 
All existing mixed beverage permittees who were issued their permits more than three (3) years ago shall pay this fee by November 1, 1988. Subsequent fee payments shall be on the renewal date of their permit. All fees shall be submitted to the City of Irving department of finance.

(a) 
A tax is hereby authorized on all telecommunications services sold within the City of Irving, Texas. For purposes of this section, the sale of telecommunications services is consummated at the location of the telephone or other telecommunications device from which the call or other communication originates. If the point of origin cannot be determined, the sale is consummated at the address to which the call or other communication is billed.
(b) 
The application of the exemption provided for in Section 321.210(a), Local Taxation, Tax Code, is hereby repealed by the City of Irving, Texas, as authorized by Section 321.210(b) thereof.
(c) 
The rate of tax imposed by this section shall be the same as the rate imposed by the City of Irving, Texas, for all other local sales and use taxes as authorized by the legislature of the State of Texas.
(d) 
The city secretary shall forward to the comptroller of the State of Texas by United States registered or certified mail a copy of this section along with a copy of the minutes of the city council's vote and discussion of this provision.
(e) 
The taxes authorized by this section shall be imposed on service beginning January 1, 1989, as provided by Section 321.102, Local Taxation.

All plots are the same price regardless of which plotter produces the output. Additionally, the prices are the same for color or black and white. Nothing herein is intended to modify the otherwise applicable charges for test-only material provided by paper print-out.
(c) 
Digital copies.
Digital copies of GIS data will be provided for Options 1 through 3 as follows:
(1) 
DXF file format for graphics, ASCII file format for text.
(2) 
CD-ROM media.
(3) 
Pre-determined coverage areas.
(4) 
All data sold will be accompanied by a license agreement signed by the purchaser prohibiting the purchaser from copying, selling and/or otherwise distributing the data.
(5) 
Any contractor working for the city will be provided, at no charge, any data needed for the contracted project, upon signing an agreement not to distribute, copy or sell the data, and must return the data to the city at the completion of the project. These agreements are to be coordinated through the department of information services.
The following options are available for purchase of digital copies of GIS data:
Option 1: Engineering Data.
This data set includes: Two-foot contours, ten-foot contours, floodplain, planimetrics, water utility lines and associated appurtenances, storm utility lines and associated appurtenances, sewer lines and associated appurtenances, lot lines, subdivisions, city limits, easements, tax numbers and addresses.
