(a) 
For purposes of this chapter, the following definitions apply:
(1) 
Median
means the intervening space, physical barrier, or clearly indicated dividing section between the two (2) roadways of opposing traffic on a public divided roadway.
(2) 
Pedestrian clear zone
means the area between the street curbs, including a median, traffic island, crosswalk or roadway at a designated street intersection listed under section 27-2 and within one hundred (100) feet from the designated street intersection as measured from the stop line. For uncurbed roadways, the pedestrian clear zone means the entire paved area of the travel lane and includes shoulders, bicycle lanes, and auxiliary lanes.
(3) 
Roadway
means the portion of the street that is paved, designated, or used for vehicular traffic as identified on the city's master thoroughfare plan. For a highway, roadway includes the access roads.

(b) 
The pedestrian clear zone designations shall be reviewed at least once a year by the city council.

(a) 
A person commits an offense if the person stops, stands, sits, lays, rests or walks in a designated pedestrian clear zone.
(b) 
This section does not apply if the person is:
(1) 
Crossing a divided roadway in the most direct route possible;
(2) 
Receiving or rendering aid in the event of an emergency; or
(3) 
Performing construction, installation or repair work in the roadway or median in accordance with a city-issued permit, license or easement.

Any person violating any of the provisions or terms of this chapter commits a misdemeanor offense, and upon conviction, shall be fined not less than one dollar ($1.00) nor more than five hundred dollars ($500.00). Each day any violation continues shall constitute a separate offense. Allegation and evidence of a culpable mental state is not required for proof of any offense defined by this chapter.
