The City of Irving Firemen's and Policemen's Civil Service was established October 28, 1971, pursuant to an election and in compliance with Article 1269m V.A.T.C.S. (now Chapter 143 of the Local Government Code).

The City of Irving Firemen's and Policemen's Civil Service shall be conducted in conformity with Chapter 143 of the Local Government Code and its amendments.

All firemen and policemen in the classified service shall earn fifteen (15) working days sick leave with pay each twelve (12) months. Firemen and policemen shall be allowed to accumulate fifteen (15) working days of sick leave with pay in one (1) calendar year. Sick leave with pay may be accumulated without limit by said firemen and policemen. In the event a fireman or policeman for any reason leaves the classified service, he shall receive, in a lump sum payment, the full amount of his salary for the period of his accumulated sick leave, provided that such payment shall not be based upon more than ninety (90) working days of accumulated sick leave. The sick leave which a fireman or policeman has accumulated at the time this section becomes effective shall not be counted as accumulated sick leave when calculating sick leave for which a fireman or policeman may receive a lump sum payment.
Injury leaves of absence shall be provided firemen and policemen with full pay for periods of time commensurate with the nature of injuries received while in the line of duty for at least one (1) year.
In order to facilitate the settlement of the accounts of deceased employees of the fire or police departments, all unpaid compensation due such employee at the time of his death shall be paid to the person or persons surviving at the date of death, in the following order of precedence and such payments shall be a bar to recovery by any other person of amounts so paid:
(1) 
To the beneficiary or beneficiaries designated by the employee in writing to receive such compensation filed with the civil service commission prior to the employee's death;
(2) 
If there be no such beneficiary, to the widow or widower of such employee;
(3) 
If there be no such beneficiary or surviving spouse, to the child or children of such employee, and descendants of deceased children, by representation;
(4) 
If none of the above, to the parents of such employee, or the survivor of them; and
(5) 
If there be none of the above, to the duly appointed legal representative of the estate of the deceased employee, or if there be none, to the person or persons determined to be entitled thereto under the laws of descent and distribution of the State of Texas.

Classified members of the Irving Fire Department and Irving Police Department shall be eligible for assignment pay in conformity with Sections 143.041 and 143.042 of the Texas Local Government Code in the amounts and under the terms and conditions as follows:

(b) 
Each chief may make assignments in the chief's department which qualify for the above listed assignment pay within the limits of budgeted amounts for salary and benefits. Each chief shall have the authority to specify the functions of each assignment area provided that each member with an assignment listed in subsection (a) shall be eligible for the listed assignment pay amount within the limits of the approved budget. Assignment pay terminates upon termination of the assignment.

(a) 
Classified members of the Irving Fire Department and Irving Police Department shall be eligible for shift differential pay in conformity with Sections 143.041 and 143.047 of the Texas Local Government Code in the amounts and under the terms and conditions as contained in this section.
(b) 
Irving Fire Department classified members.
(1) 
Classified members of the Irving Fire Department who normally work a shift in which more than fifty (50) percent of the time worked is after 6:00 p.m. and before 6:00 a.m. shall be paid shift differential pay at a rate of one hundred dollars ($100.00) per month.
(2) 
Classified members of the Irving Fire Department who normally work rotating shifts, which shifts alternate hours of work on a periodic basis between a shift which would qualify for pay under subsection (b)(1) and a shift which would not qualify under subsection (b)(1), which period is normally longer than one (1) week shall be paid shift differential pay at a rate of seventy-five dollars ($75.00) per month.
(c) 
Irving Police Department classified members.
(1) 
Classified members of the Irving Police Department who normally work a shift in which more than fifty (50) percent of the time worked is after 6:00 p.m. and before 6:00 a.m. shall be paid shift differential pay at a rate of three (3) percent of base pay.
(2) 
Classified members of the Irving Police Department who normally work rotating shifts, which shifts alternate hours of work on a periodic basis between a shift which would qualify for pay under subsection (c)(1) and a shift which would not qualify under subsection (c)(1), which period is normally longer than one (1) week shall be paid shift differential pay at a rate of two (2) percent of base pay.
