The term "parking lot" as used in this article shall be construed to mean and include any place maintained for the outdoor parking of vehicles where such parking is permitted upon payment of compensation.

(a)
It shall be unlawful to operate a parking lot without a parking lot permit issued by the City of Irving Department of Planning and Inspection. Applications for such permits shall be made prior to August 1 of each year to the Department of Planning and Inspection, and shall contain all necessary information to insure compliance with the provisions of this chapter. This information shall include, but not be limited to, the address, a description of the location, the size and number of vehicles to be accommodated and a plot plan accurately depicting the adjacent public streets, the location of all ingress and egress with public streets, the location of all driveways, fire lanes, each individual parking space, the total number of parking spaces, the required striping and the type of parking surface shall be identified. Each application shall be on a form promulgated by the Department of Planning and Inspection and shall be accompanied by at least three (3) plot plans and the required fees. If the parking lot meets all of the requirements of this chapter and the other ordinances of the city, the Department of Planning and Inspection shall accept the application, and perform the required inspection. If approved by the director of building inspection or his designated agent, an endorsed copy of the plot plan and the permit shall be returned to the applicant and one (1) complete set of documents will be forwarded to the traffic division of the Irving Police Department.

Each permit shall be effective from August 1 of each year until August 31 of the following year provided that no permit shall be effective prior to the date of approval by the Department of Planning and Inspection. All applications requesting an immediate effective date but received after August 1 shall be considered late and shall be required to pay a late charge of twenty-five dollars ($25.00) for an individual inspection.

Parking spaces required by the zoning ordinance may not be included in a commercial parking lot unless it can be reasonably demonstrated in writing to the building inspector that the commercial parking lot shall not interfere with the parking required by the Zoning Ordinance No. 1144. Where there is to be a shared parking facility, any restrictions on the commercial parking lot including but not limited to time of day, day of the week and other restrictions shall be set forth in highlighted text on the plot plan.

Not more than one car for each one hundred eighty (180) square feet of area shall be accepted for parking in any such place. Each parking lot shall be so marked as to show the parking space allotted each car, and shall have sufficient entrances and exits to permit the entrance and egress of cars without obstruction to traffic.

No driveway to a parking lot shall be constructed excepting in full compliance with the ordinances relative to the issuance of permits for driveways; and it shall be the duty of the operator of each parking lot to maintain the sidewalk and parkway over which such driveway passes in good condition.

It shall be unlawful to operate any parking lot unless it shall be graded to drain properly and shall be paved with one of the following materials:
(a)
Five (5) inches of gravel with one course penetration.
(b)
Three (3) inches of gravel with one and one-half (1½) inches of hot mix asphaltic concrete.
(c)
Five (5) inches two thousand five hundred (2,500) P.S.I. concrete with #3 bars on twenty-four (24) inch centers or six (6) inch by six (6) inch wire mesh reinforcement.
(d)
Six (6) inch lime stabilized base with one-half (½) inch Slurry Seal.
(e)
Six (6) inch lime stabilized base with two (2) course penetration.

(a)
It shall be unlawful for any person operating a parking lot to fail to produce a City of Irving parking lot permit and approved plot plan for the location in question when requested by an employee of the Irving Police Department or of the Irving Department of Planning and Inspection.
(b)
It shall be unlawful to operate a parking lot at a variance from the approved plot plan.
(c)
Any person who violates any provision of this article shall be guilty of a misdemeanor and upon conviction thereof, shall be subject to a fine not to exceed five hundred dollars ($500.00).
