A chapter establishing rules, regulations and standards governing the subdivision of land, land development, and mobile home parks within the Township of Fermanagh, Juniata County, Pennsylvania setting forth procedures to be followed in applying and administering the chapter, and providing penalties for the violation thereof.
This chapter shall be known and may be cited as the "Fermanagh Township Subdivision and Land Development Ordinance."
It is the general intent of this chapter to regulate the subdivision and development of land in the Township of Fermanagh to insure that:
A. 
The layout or arrangement of the subdivision or land development and all other characteristics of the subdivision or land development shall conform to the Comprehensive Plan for the Township of Fermanagh, most recent edition, and shall further the orderly and appropriate use of the land.
B. 
Streets in and bordering a subdivision or land development shall be coordinated with existing streets, parks and other features of the Township, and shall be of such widths and grades and in such locations as deemed necessary to accommodate and regulate flows of prospective traffic.
C. 
Adequate easements of rights-of-way shall be provided for drainage and utilities.
D. 
Adequate open space for traffic, recreation, light, air, and effective drainage shall be provided in subdivisions and land developments and that reservations, if any, by the developer of any area designed for use as public grounds shall be of suitable size and location for their designated uses.
E. 
Land which is subject to flooding, subsidence or other environmental limitation either be made safe for the purpose for which such land is proposed to be used or that such land shall be set aside for uses which shall not endanger life or property or further aggravate or increase the existing menace.
F. 
Adequate facilities for transportation (including streets, walkways, curbs, gutters and streetlights), water, fire hydrants, sewerage, storm sewers, schools, parks, playgrounds, and other public facilities shall be installed in the subdivision or land development.
G. 
Adequate provisions for safety from fire, panic and other dangers shall be provided for in subdivisions and land developments.
H. 
Innovation in site design and improvement construction is encouraged to the greatest possible extent consistent with the need to meet the spirit and intent of this chapter.
