A. 
The following land subdivision principles, standards, and requirements shall be applied by the Board of Supervisors of the Township in evaluating plans for proposed subdivisions.
B. 
The standards and requirements outlined herein shall be considered minimum standards and requirements for the promotion of public health, safety, morals and general welfare.
C. 
Where literal compliance with the standards herein specified is clearly impractical, the Board of Supervisors may modify or adjust the standards to permit reasonable utilization of property while securing substantial conformance with the objectives of this chapter.
D. 
Whenever other Township regulations impose more restrictive standards and requirements than those contained herein, such other regulations shall be observed.
A. 
Zoning. Proposed land use shall conform to the provisions of Chapter 175, Zoning.
B. 
Hazards. Land subject to hazard to life, health or property shall not be subdivided for residential purposes until such hazards have been eliminated or unless adequate safeguards against such hazards are provided by the subdivision plan.
C. 
Neighborhood coordination. Proposed subdivision shall be coordinated with existing nearby neighborhoods, so that the community, as a whole, may develop harmoniously.
A. 
Township plans. Proposed streets shall be properly related to such street plans, or parts thereof, as have been officially prepared and adopted by the Township including the Comprehensive Plan for the Township of Fermanagh, most recent edition.
B. 
Other plans. Proposed streets shall further conform to such Township, county and state road and highway plans as have been prepared, adopted and/or filed as prescribed by law.
C. 
Topography. Streets shall be logically related to the topography.
D. 
Residential service. Residential service streets shall be so laid out as to discourage through traffic, but provision for street connections into and from adjacent streets will generally be required. Such street systems shall be designed so as to minimize street intersections and pedestrian vehicular confliction points.
E. 
Resubdivision. If lots resulting from original subdivision are large enough to permit resubdivision or if a portion of the tract is not subdivided, adequate street rights-of-way to permit further subdivision shall be provided as necessary.
F. 
Marginal access streets. Where a subdivision abuts or contains an existing or proposed feeder, connector, or arterial street, the Supervisors may require marginal access streets, rear service alleys, reverse frontage lots or such other treatment as will provide protection for abutting properties or reduction in the number of intersections with the major street, and separation of local and through traffic.
G. 
New partial street. New half or partial streets shall not be permitted, except where essential or reasonable subdivision of a tract in conformance with the other requirements and standards of this chapter and where, in addition, satisfactory assurance for dedication of the remaining part of the street can be secured.
H. 
Existing partial street. Wherever a tract to be subdivided borders on an existing half or partial street, the other part of the street shall be plotted within such tract.
I. 
Dead-end streets. Dead-end streets shall be prohibited, except as stubs to permit future street extension into adjoining tracts, or when designed as a cul-de-sac.
J. 
New reserve strips. New reserve strips, including those controlling access to streets shall be avoided.
A. 
Local roads. Roads providing direct access to adjacent land. These roads connect farms, individual residences and commercial properties to higher classes of roadways. Trip lengths are short and speeds are low. Local roads may be designated as private roads providing:
(1) 
The subdivision is not intended for permanent residential use.
(2) 
No more than five lots are served by the private road.
(3) 
The road is entirely within the perimeter of the tract being subdivided and will not provide access to adjoining tracts.
(4) 
Ownership of the road right-of-way remains entirely with the subdivider, who shall be solely responsible for all maintenance of the road.
B. 
Collector roads. This classification includes roads that provide connection with local access roads and arterial highways. Traffic volumes and trip lengths vary greatly with operating speeds being between 35 m.p.h. to 50 m.p.h.
C. 
Arterial highways. Included in this classification are highways which develop large volumes of traffic on an inter-county or inter-township-borough-city basis. Trip lengths are usually five miles or greater and high operating speeds are permitted.
D. 
The Supervisors of the Township shall be under no obligation to accept dedication of the road until such time as the road is graded, paved and in all other respects brought into conformance with the requirements of this chapter pertaining to road-way design for public roads.
Street shall be designed in accordance with the following criteria, and the Guidelines for Design of Local Streets and Roads (PA DOT Publication 70).

B. 
Additional width. Additional right-of-way and cartway widths may be required by the Board of Supervisors for the following purposes:
(1) 
To promote public safety and convenience.
(2) 
To provide parking space in commercial districts and in areas of high-density residential development.
C. 
Extension of nonconforming street. Short extension of existing streets with lesser right-of-way and/or cartway widths than prescribed by § 140-22 above may be permitted, provided however, that no section of the new right-of-way less than 50 feet in width shall be permitted.
D. 
Width addition to nonconforming street. Where a subdivision abuts or contains an existing street of inadequate right-of-way width, additional right-of-way width in conformance with the above standards shall be provided.
E. 
Cul-de-sac streets. Local roads may be built as culs-de-sac provided they meet the following criteria:
(1) 
Length. Culs-de-sac permanently designed as such, so far as possible, shall be a minimum of 250 feet, and should not exceed 500 feet in length.
(2) 
Turnaround. Culs-de-sac shall be provided at the closed end with a hard surface turnaround having a minimum radius to the outer pavement edge, or curbline, of 50 feet.
(3) 
Extension. Unless future extension is clearly impractical or undesirable, the turnaround right-of-way of the same width as the street shall be carried to the property line in such a way as to permit future extension of the street into the adjoining tract.
F. 
Alignment. Alignment should conform to topography, following closely the natural contours, and should be consistent with the following criteria:

Sight distance. Sight distance shall be provided with respect to horizontal and vertical alignment. Passing and stopping sight distance shall comply with the minimum requirements of Guidelines for Design of Local Streets and Roads (PA DOT Publication 70), based on highway classification and speed limit.
H. 
Curbs. Curbs shall be constructed if directed by the Township Supervisors.
I. 
Sidewalks. Sidewalks may be required on both sides of the street in subdivisions with typical lot width of 90 feet or less at the building setback lines, and where semidetached, row, or multifamily structures are planned. Sidewalks may also be required by the Supervisors on both sides of the street in subdivisions where lots are greater than 90 feet in width if it would be desirable to continue sidewalks that are existing in adjacent subdivisions, or to provide access to community facilities, such as schools, shopping areas and recreation areas. Sidewalks shall be located within the street right-of-way, one foot from the right-of-way line, and shall be a minimum of four feet wide, except along collector and arterial streets, and in the vicinity of shopping centers, schools, recreation areas, and other community facilities, where they shall be a minimum of five feet wide. Generally, a grass planting strip should be provided between the curb and sidewalk. Where curbing is used, a grass planting strip shall be provided. Sidewalks shall be constructed as specified by the Board of Supervisors.
All roads and streets including shoulders, which are to be constructed as part of an approved subdivision plan and dedicated to the Township shall be paved with an all-weather surface consisting of eight inches of 2A modified stone, four inches of B.C.B.C., and 1 1/2 inches of ID2 wearing course.
A. 
Streets shall be laid out to intersect as nearly as possible at right angles. No street shall intersect another at an angle of less than 60°.
B. 
Multiple intersections involving junction of more than two streets shall be avoided.
C. 
Clear sight triangles of 150 feet measured along street center lines from their point of junction shall be provided at all intersections except on rural service roads and service streets where the Board of Supervisors may consider requests for variations on the recommendation of the Planning Commission. Such considerations will be based on design factors in which it would be difficult to meet the required minimums, but that the intended safety is not reduced.
D. 
To the fullest extent possible, intersections with major traffic streets shall be located not less than 800 feet apart, measured from center line to center line.
E. 
Streets entering opposite sides of another street shall be laid out either directly opposite one another or with a minimum offset of 200 feet between the inside right-of-way lines.
F. 
Minimum curb radii at street intersections shall be 20 feet for intersections involving residential service streets, 25 feet for intersections including other types of streets, or such greater radius as is suitable to the specific intersection.
A. 
The length, width and shape of blocks shall be determines with due regard to:
(1) 
Provision of adequate sites for building of the type proposed.
(2) 
Chapter 175, Zoning.
(3) 
Topography.
(4) 
Requirements for safe and convenient vehicular and pedestrian circulation.
B. 
Blocks shall have a maximum length of 1,600 feet and, so far as practicable, a minimum length of 800 feet; along arterial highways, blocks shall not be less than 1,000 feet long.
C. 
Residential blocks should be of sufficient depth to accommodate two tiers of lots, except where reverse frontage lots in accordance with § 140-19F are used.

A. 
Lot dimensions and areas shall conform to Chapter 175, Zoning, except in cases where additional area is required in conformance with § 140-29D.
B. 
Side lots shall be substantially at right angles or radial to street lines.
C. 
Residential lots shall front on a municipal street, existing or proposed.
D. 
Lot lines shall follow municipal boundaries, wherever possible, in order to avoid jurisdictional problems.
E. 
Generally, the depth of residential lots shall be not less than one nor more than 2 1/2 times their width.
F. 
Cluster option.
(1) 
As an exception to the minimum lot sizes required under Chapter 175, Zoning, Article V, District Regulations:
(a) 
Lots in the Rural Agriculture District may be reduced by 25%;
(b) 
Lots in the Residential District may be reduced to 11,500 square feet;
(2) 
Provided, however, that the following conditions must be met:
(a) 
The location of the proposed development is approved by the Board of Supervisors;
(b) 
The total number of dwelling units does not exceed the number that would be permitted under the density regulations of the applicable district;
(c) 
The total area of the site must be reduced by 15% to allow for road rights-of-way. Twenty percent or six acres of the remainder, whichever is greater, must be dedicated to common open space to be maintained in a manner approved by the Board of Supervisors;
(d) 
Setback requirements remain unchanged;
(e) 
All other applicable regulations of this chapter pertaining to subdivision and land development must be complied with.
A. 
General requirements.
(1) 
Storm sewers, culverts and related installations shall be provided to:
(a) 
Permit unimpeded flow of natural watercourses and other existing drainage facilities.
(b) 
Insure adequate drainage of all low points along the line of streets.
(c) 
Intercept stormwater runoff along streets at intervals related to the extent and grade of the area drained.
(d) 
Provide positive drainage away from on-site sewage disposal facilities.
(e) 
Reduce the post-development runoff volumes.
(2) 
Storm sewers and related installations shall be required as needed as determined by the Board of Supervisors.
(3) 
Where existing storm sewers are accessible, proposed subdivisions shall be required to connect therewith if adjudged feasible.
(4) 
Where a subdivision is traversed by a watercourse, drainageway channel, or stream, there shall be provided a drainage easement at least 30 feet in width measuring 15 feet on each side of the stream or channel to preserve unimpeded flow or natural drainage, or for the purpose of widening, deepening, relocating, improving or protecting such drainage facilities. Any changes in the existing drainage way shall be subject to the approval of the Pennsylvania Department of Environmental Protection.
(5) 
Appropriate grates shall be designed for all catch basins, stormwater inlets and other entrance appurtenances except pipe entrances, to insure that maximum openings do not exceed six inches on a side.
(6) 
All storm drainage facilities constructed along or crossing state or Township roads shall conform to the applicable requirements of the Pennsylvania Department of Transportation specifications related to such drainage facilities.
(7) 
Lots shall be laid out and graded to provide positive drainage away from new and existing buildings.
B. 
Design standards. Computations for determining stormwater runoff and for the design of stormwater management facilities shall be based upon the Soil Cover Complex method described in either TR-55, Urban Hydrology for Small Watersheds; the United States Department of Agriculture, Natural Resource Conservation Service Engineering Field Manual or the Rational Method. Computations based upon an alternative method may be accepted upon recommendation of the Township Engineer and approval of the Township Board of Supervisors. The following standards shall apply:
(1) 
All designs and calculations shall take into consideration the entire upstream drainage basin.
(2) 
All predevelopment calculations unless in woodland, shall be based upon the assumption of grass cover and predevelopment stormwater runoff shall be calculated for the two-, ten-, twenty-five- and 100-year storm events. Where the site contains existing impervious surface, up to 50% of the impervious area may be considered as an existing predevelopment condition.
(3) 
All stormwater detention pond design and calculations shall be accompanied by the following:
(a) 
Either singular or composite inflow hydrographs.
(b) 
Stage-storage data.
(c) 
Stage-discharge data.
(d) 
Storage-routing calculation.
(e) 
Other data as required by the Township Engineer.
(4) 
Release rates from storage structures shall coincide with all predevelopment runoff rates for the primary outlet structure.
(5) 
Storage structures shall be sized to store the difference between the post development twenty-five-year peak runoff and the predevelopment twenty-five-year peak runoff for the primary outlet structure.
(6) 
All storage structures or facilities shall be designed with emergency spillways sufficient to handle the 100-year post development storm event.
(7) 
Culverts, pipes, and other water carrying structures shall be designed to handle peak discharge from the ten-year post development storm event. Cross culverts under Township roads shall be designed to pass the twenty-five-year post development flow.
(8) 
The SWMP shall include calculations indicating velocities of flow, grades, sizes, and capacities of water carrying structures, debris or sedimentation basins, and detention ponds and sufficient design information to construct such facilities.
(9) 
Subsurface infiltration shall not be permitted in areas where it will adversely affect subsurface sewage disposal.
(10) 
Subsurface infiltration will only be permitted after the applicant has completed an engineering study of the site. This study shall include but is not limited to:
(a) 
Soil compatibility and permeability, as proven by geotechnical analysis.
(b) 
Maintenance program.
(c) 
Calculations as per a proven theory or acceptance by an authority in the field of subsurface infiltration.
(11) 
All natural drainage ways and existing contouring of predevelopment drainage patterns shall be preserved to the maximum extent possible, and post-development drainage patterns shall simulate predevelopment patterns.
(12) 
Calculations for development shall anticipate the maximum area to be impervious, as permitted in Chapter 175, Zoning, of this Code.
(13) 
Stormwater runoff shall be based on the following twenty-four-hour storm events:

(f) 
The normal maximum velocity of open channel flows shall not exceed 10 feet per second.
(15) 
Minimum permitted velocity of all channels/pipes shall be three feet per second.
(16) 
Horizontal and vertical alignment changes of the collection system shall be achieved through the use of manholes and/or inlets.
(17) 
The minimum slope for unlined, open channels shall be 2.0%; minimum slope for pipes and lined channels shall be 0.5%.
(18) 
Energy dissipaters/erosion control devices shall be placed at the outlets of all pipes where flow full velocities exceed maximum permitted channel velocities.
(19) 
Vertical pipes, inlets and other surface water receiving structures shall be installed with trash racks, or so designed to control trash accumulation.
(20) 
Stormwater runoff channels shall be designed and installed to avoid trapping excess sediment, except if structures are so designed to trap sediment.
(21) 
Where stormwater detention basins are also intended for sediment control, they will be designed to meet the requirements of Chapter 102, Erosion Control, of the Rules and Regulations of the Pennsylvania Department of Environmental Protection.[1]

(22) 
Storage of equivalent stormwater runoff for a portion of a property may be considered in lieu of storage of generated runoff provided:
(a) 
The site is located so that it is physically impossible to detain runoff from the proposed facilities or drainage problems exist upgrade that would impact upon the site or downgrade properties.
(b) 
The impact of generated runoff discharging off site from the subdivision or land development is determined by the Township Engineer to be negligible and not detrimental to adjacent properties.
(c) 
Implementation of equivalent storage shall be determined applicable and feasible by the Township Engineer.
(23) 
Use of parking lots for detention storage may be approved by the Board of Township Supervisors, after review and recommendations from the Township Engineer.
(24) 
No stormwater runoff or natural drainage water shall be so diverted as to overload existing drainage systems, or create flooding or the need for additional drainage structures on other private properties or public lands, without approved provisions being made by the developer for properly handling such conditions.
C. 
Ownership and maintenance program. Each SWMP shall contain provisions which clearly set forth the ownership and maintenance responsibility of all temporary and permanent stormwater management facilities and erosion and sediment pollution control facilities, including:
(1) 
Description requirements of temporary and permanent maintenance.
(2) 
Establishment of suitable easements for access to all facilities by County and Township officials.
(3) 
Identification of the responsible party or entity for ownership and maintenance of both temporary and permanent stormwater management and erosion control facilities. In meeting this requirement, the following priority is herein established:
(a) 
Maintenance by private entity. In cases where permanent control facilities are owned by a private entity (such as a homeowners' association), such entity shall be responsible for maintenance. In this case, a legally binding agreement between the entity and the Township shall be made providing for maintenance of permanent control facilities, including the inspection by the Township of all such facilities deemed critical to the public welfare on a regular basis and after each major flood event.
(b) 
Maintenance by individual lot owners.
[1] 
When stormwater management facilities are located on individual lots, and when they are the responsibility of the landowner to maintain, a description of the facility or system and the terms of the required maintenance shall be recorded with the approved subdivision plan among the deed records of Juniata County, Pennsylvania.
[2] 
If the Township determines at any time that any permanent stormwater management facility as provided under Subsection C(3)(a) and (b) above has been eliminated, altered, or improperly maintained, the owner of the property shall be advised of the corrective measures required and given a reasonable period of time to take necessary action. If such action is not taken by the property owner, the Township may cause the work to be done and a lien for costs may be placed against the property in accordance with the requirements of the Municipal Lien Law.[2]

(c) 
Township ownership. The applicant may offer to dedicate the stormwater management facilities to the Township. Dedication of the facilities to the Township shall be done in accordance with the requirements of this chapter. As a condition of Township acceptance of said facilities, the applicant shall provide sufficient funds, as estimated by the Township Engineer, to cover anticipated maintenance and repair costs for 10 years from the date of final plan approval.

A. 
Standards:
(1) 
No subdivision or land development plan shall be approved unless there has been a plan approved by the Board of Supervisors that provides for minimizing erosion and sediment pollution consistent with this section, and improvement bond or other acceptable securities are deposited with the Township in the form of an escrow guarantee which will ensure installation and completion of the required improvements; or there has been a determination by the Board of Supervisors that a plan for minimizing erosion and sediment pollution is not necessary.
(2) 
Measures used to control erosion and reduce sediment pollution shall at a minimum meet the standards and specifications of the Clean Streams Law[1] and 25 Pa. Code Chapter 102, Erosion and Sedimentation Control.

A. 
Each property shall connect with an approved public sewer system, if accessible. Where the sewer is not yet accessible but is planned for extension to the vicinity of the subdivision, the subdivider shall install the sewer lines, including lateral connections as may be necessary to provide adequate service to each lot when connection with the sewer system is made. The sewer lines shall be suitably capped at the limits of the subdivision and the laterals shall be capped at the street right-of-way line. When capped sewers are provided, on-site disposal facilities shall also be provided. All such facilities shall be subject to requirements of Act 537, the Pennsylvania Sewage Facilities Act,[2] and current Rules and Regulations of the Pennsylvania Department of Environmental Protection.

B. 
Public sanitary sewers installed by the developer shall conform to the requirements of any authority having jurisdiction over sanitary sewers in the subdivision and Pennsylvania Departmental Protection requirements in that agency's "sewage manual."
C. 
Public sanitary sewers shall not be used to carry stormwater and shall be guarded against infiltration.
D. 
Where an approved public sanitary sewage system is not accessible or planned, an approved on-site sewage disposal system shall be provided, which system shall comply with the requirements of Chapter 123, Sewers and Sewage Disposal, Article V, On-Lot Subsurface Sewage Facilities, the requirements of the Pennsylvania Department of Environmental Protection Rules and Regulations and Act 537, the Pennsylvania Sewage Facilities Act.

A. 
Where a public or an approved community or piped common water supply system is accessible or provided, all properties in subdivision shall be connected to such system.
B. 
Where a public or an approved community or piped common water supply system is not accessible or provided, an approved individual on-site water supply facility shall be provided.
C. 
Where wells are provided, such wells should be drilled at least 50 feet deep and cased in the bedrock a minimum of 12 inches and should have a production capacity of at least five gallons per minute of safe, potable drinking water, as certified by the Pennsylvania Department of Environmental Protection.

A. 
Alleys are prohibited in developments of single-family detached residences.
B. 
Private driveways, where provided, shall be located not less than 90 feet from the intersection corner of corner lots and shall have such grades as to furnish a safe and convenient parking space. The grades shall be such as to eliminate any increase in stormwater runoff from the driveway into any public street. Every new driveway shall have a drainpipe not less than 15 inches in diameter installed at its connection to any public street to adequately maintain drainage along the public street.
C. 
Each proposed lot in a subdivision shall be provided with at least the minimum number of off-street parking spaces as required in Chapter 175, Zoning, of this Code.
D. 
Easements with a width of 10 feet shall be provided as necessary for utilities.
E. 
To the fullest extent possible, easements shall be centered on, or adjacent to, rear or side lot lines.
A. 
Land requirements. The Planning Commission, at its discretion, may designate portions of a subdivision for parks, playgrounds or other public uses. Areas set aside for recreational or school purposes shall be reasonably compact parcels, placed to serve all parts of the subdivision, accessible from a public street, and not excessively irregular in terrain.
B. 
Play lots. Play lots for children of pre-school age shall be at least 2,000 square feet in area; playgrounds for active sports shall be not less than 1.5 acres.
C. 
Landmarks and open spaces. Wherever possible, subdividers shall preserve trees more than six inches in diameter at the base of the trunk and groves and waterways as common open space for the residents of the subdivision. Scenic points, historic spots, and other community assets and landmarks shall be preserved.
D. 
Open space or recreation areas. In subdivisions which provide housing facilities for 15 or more families, the Planning Commission may consider the need for a suitable open areas for recreation. Improvements to the open space or recreation area may be required, and the land shall be dedicated to the Township in an acceptable condition. Acreage standards to be used by the Planning Commission as guides in requesting the reservation of open space for recreation shall be as follows:

Specifications and plans for a subdivision layout which includes water, sewage systems, and stormwater drainage systems, shall be prepared by a registered professional engineer of the State of Pennsylvania, and shall bear his seal and signature.
A. 
Permanent stone or concrete monuments shall be accurately placed at the intersections of all lines along the boundary (perimeter) of the property being subdivided.
B. 
All monuments shall be placed by a surveyor so that the scored (by an indented-pin in the top of the monument) point shall coincide exactly with the point of intersection of the lines being monumented.
C. 
Monuments shall be set with their top level four inches above finished grade.
D. 
All lots shall be pinned at all corners by a registered surveyor.
E. 
All streets shall be monumented (preferably on the right-of-way lines) at the following locations:
(1) 
At least one monument on the diagonal corners of each intersection.
(2) 
At changes in direction of street lines, excluding curb arcs at intersections.
(3) 
At each end of each street line, excluding arcs at intersections.
(4) 
At intermediate points wherever topographical or other conditions make it possible to sight between two otherwise required monuments.
(5) 
At such other places along the line of streets as may be determined by the Township to be necessary so that any street may be readily defined in the future.
Street name signs shall be installed at all street intersections. The design and placement of such signs shall be subject to approval by the Township Supervisors. Names appearing on such signs shall be approved by the Board of Supervisors.
In accordance with the conditions to be agreed upon by the subdivision, the municipality and the appropriate public utility, streetlights shall be required to be installed in a subdivision.
A. 
Within any land development or subdivision consisting of over 10 lots, street trees shall be planted along all streets where suitable street trees do not exist.
B. 
As a recommended standard, street trees shall be planted at intervals of not more than 45 feet, or an equivalent number shall be planted in an informal arrangement.
C. 
Street trees shall not be planted opposite each other but shall alternate.
D. 
At intersections, trees shall be located no closer than 75 feet from the intersection of the street right-of-way lines.
E. 
Where the planting strip between the curb and sidewalk is less than seven feet wide, the street trees shall be planted on the lots.
F. 
Street trees and other required plants shall be nursery stock. They shall be of symmetrical growth, free of insects, pests, and disease, and suitable for street use and durable under the maintenance contemplated.
G. 
The minimum trunk diameter measured at a height of six inches above the finished grade level shall be a minimum of 1 1/2 inches.
H. 
Where buffer strips are required along two different land uses and along the rear of reverse-frontage lots, an evergreen planting screen shall be used to provide an adequate visual barrier. The plant material used shall be of a minimum height of four feet at the time of the planting and shall be planted in a staggered arrangement in order to provide an immediate effect. Deciduous and semi-deciduous shrubs may be used with evergreens to provide an immediate effect and to provide accent and color. It is recommended that a landscape architect licensed by the Commonwealth of Pennsylvania be employed to insure the proper use and arrangement of plant material and to provide an aesthetically pleasing effect. The following are evergreens recommended for screening purposes:
(1) 
Picea abies, Norway Spruce.
(2) 
Thuja orientalia, Oriental Arbor-vitea.
(3) 
Tsuga canadensis, Canadian Hemlock.
(4) 
Tsuga caroliniana, Carolina Hemlock.
