It shall be unlawful for any person to purchase junk of any kind or nature from any person under the age of 16 years.
It shall be unlawful for any person, firm or corporation to use any loudspeaker, radio, siren or other objectionable noise-making device on the streets of Albertville without first obtaining a permit from the Mayor of the City.

It shall be unlawful for any person to maintain or operate or permit or cause the maintenance or operation of any music box, rocola, or similar device or any speaker attached thereto that is not fully enclosed within the confines of the main or principal building on the premises where such a device or speaker is maintained or operated. The operation of such device or speaker on a porch, veranda, or patio of any such building shall not be heard beyond the immediate area surrounding the principal building.

(a)
It is hereby declared a nuisance and shall be unlawful to operate or play any radio, musical instrument, or similar device, whether from a motor vehicle or by a pedestrian, in such a manner as to be plainly audible to any person other than the player or operator of the device at a distance of 10 feet in the case of a motor vehicle or 15 feet in the case of a pedestrian.
(b)
It is hereby declared a nuisance and shall be unlawful to operate or play any radio, television, phonograph, musical instrument, or similar device which produces or reproduces sound, whether from a business or a residence, in such a manner as to be plainly audible at a distance of 50 feet to any person in a commercial, residential, multifamily dwelling or public place.
(c)
Violation of this section shall be a violation and punishable as provided in § 1-8 of this Code.
(d)
Nothing in this section shall be construed to prohibit special performances by a band or orchestra in a hall, building, or in the open air after proper permits have been obtained from the Chief of Police.
(e)
Nothing in this section shall be construed to prohibit the ringing of bells or chimes by churches within the City.
(f)
Nothing in this section shall be construed to prohibit any noises or sounds produced by radios, sirens, or other equipment attached to or being operated by any police, fire, rescue, or other emergency vehicles or personnel.
(g)
Nothing in this section shall be construed to prohibit the conducting of live remote broadcasts by duly licensed radio stations upon business premises, at the request of the owner of the business. Said live remote broadcasts shall be limited to daylight hours only.
(h)
Each violation shall be a separate offense.

It shall be unlawful for any person to conduct a yard sale or other sale of goods, wares or merchandise within the City or within the police jurisdiction thereof except as such shall comply with all of the following conditions and provisions:
(a)
Such goods, wares or merchandise shall be drawn from the personal household or constitute items of personal use of a resident of the dwelling where such sale is conducted and shall have been owned by such person for more than one year prior to the date of such sale.
(b)
There shall be no more than two sales at any residence, church or school within any one calendar year with each permitted sale to extend not more than two days of consecutive duration; provided, however, that yard sales shall be allowed at business locations that are to be held for charitable purposes not to exceed two per year.
(c)
There shall be no pooling of possessions from other households or by persons all of whom are not permanent residents at the location where the sale is conducted unless each person participating has been issued a permit.
(d)
There shall be no signs or advertisements of such sale posted on the public right-of-way or on the private property of others (example: utility poles, City traffic control signs and other public fixtures).
(e)
All yard sale signs shall contain the address of the permit holder.
(f)
A permit for each such sale shall be obtained from the City Clerk prior to the holding of such sale upon application forms supplied by the City Clerk, which forms shall require pertinent data as to the dates and nature of the sale items to be sold, the owner or owners of the merchandise and the person or persons responsible for complying herewith. No permit shall be issued until and unless all of the provisions of this section shall have been complied with in every respect. There shall be no charge for any permit issued under this section.

It shall be unlawful for any person to solicit charitable contributions or business from operators or passengers in vehicles which are in transit on any public road or highway in the City.

(a)
Generally.
(1)
It shall be unlawful for any person to cause or allow to be placed, left, or kept upon any lot or parcel of land within the corporate limits of Albertville, Alabama, any remote and unattended receptacle, bin, box, container, portable building or structure for the purpose of collecting, holding or storing discarded clothing, furniture, household hardware, appliances, household items or any other tangible items.
(2)
Exceptions. Excepted from the requirements of this section are:
a.
Any accessory structure, portable building or other secondary structure which is located on the same property on which a primary structure is located and which is incidental to the occupation and use of any residential or commercial structure, provided said structure is maintained and located in accordance with the ordinances and regulations of the City.
b.
Any dumpster, trash receptacle, or other container for the collection and storage of trash, garbage, or debris, provided said dumpster, trash receptacle, or container is maintained and located in accordance with the laws of the City.
c.
Any receptacle, box, bin, container, portable building or structure that is located on the premises where the daily business operations of a charitable organization are conducted, provided that such receptacle, box, container, portable building, or structure is maintained in accordance with the Zoning Ordinance and other ordinances of the City.
(b)
Enforcement.
(1)
The Chief of Police for the City or his or her authorized representative shall be responsible for and possess the authority to enforce the provisions of this section. In the event that any person shall fail or refuse to comply with the requirements of this section, the Chief of Police or his or her authorized representative for the City may cause to be served upon such person, in person or by first-class mail, a written official notice apprising the person of the violation of this section and requiring such person to comply with this section within a time stated in said notice, which shall be a period of not less than 15 calendar days.
(2)
In the event that a person fails to comply with the notice which has been served upon him or her in accordance with this section, then the Chief of Police or any law enforcement officer working under his or her supervision may appear before the Municipal Court Magistrate and make oath as to the facts constituting a violation of this section and apply for a summons or warrant with respect to any alleged offense. Any person found guilty of a violation of this section in the Municipal Court of Albertville, Alabama, shall be subject to the same penalties as provided for violations of City ordinances in § 1-8 of the City Code of Ordinances.
(3)
In addition to or in lieu of the foregoing enforcement procedure, the Chief of Police or his or her authorized representative may cause said receptacle, bin, box, container, portable building or structure and its contents which are in violation of this section to be removed from its location and impounded at a depository designated by the Chief of Police for such purpose. Said receptacle, bin, box, container, portable building or structure, and contents shall be held at said depository for a period of 30 days during which time it may be retrieved by the owner, provided the owner reimburses the City for the reasonable costs of transportation to and storage in the depository. In no event shall the owner be required to reimburse the City more than $100. After 30 days, said receptacle, bin, box, container, portable building or structure and contents if any shall be disposed of in the most suitable manner as determined by the Chief of Police.

(a)
It shall be unlawful for any person or business entity to place or allow to be placed any type vehicle upon property owned by the City for the purpose of storage and/or display and/or sale of such vehicle.
(b)
It shall be presumed that any vehicle placed upon property owned by the City for a period of 12 consecutive hours or more is placed there for the purpose of storage and/or display and/or sale of such property, and that such vehicle was placed on City property by the registered owner of such vehicle.
(c)
Any person or business entity violating this section shall be punished as provided in § 1-8 of this Code for each day that any vehicle remains on City property in violation of the terms of this section. The minimum fine shall be $50. Additionally, the City shall have the right to remove at the owner's expense any vehicle placed on the City property in violation of this section.

The smoking of any tobacco products is prohibited within 100 feet of any playing field at any and all events both inside and outside the City-owned sports and recreation facilities. Anyone violating these provisions shall be punished as provided in § 1-8 of this Code.
