The City hereby adopts the Alabama Department of Transportation Utility Manual (as written and future amendments thereto) as standards for use by the City for accommodating utilities on roads and streets under the jurisdiction of the City on those roads and streets which have or will involve the expenditure of state or federal highway funds.

It shall be unlawful for any person to place or cause to be placed, without the prior consent of the City, any structure of concrete, asphalt or similar substance upon a City road right-of-way which substantially alters or impedes the natural flow of surface waters over or along said road right-of-way.

It shall be unlawful for the owners or occupants of any building in the City to permit or cause to be poured, thrown, or run in, into, upon or against any of the sidewalks of the City any water collected on any of the buildings in the City, either by permitting the same to run onto the sidewalks or to be poured thereon or thrown from any gutter or downpipes, pipes or passageways leading from any of said buildings onto, over, on or against any of the sidewalks of the City, but nothing in this section shall prevent the owners or occupants of any building from so constructing waterspouts, gutters or downpipes to their buildings so as to convey said water through an opening underneath any sidewalks, provided it is so constructed as not to operate upon or over the sidewalks, or pour thereon from said building.

No person, firm, or corporation shall install or cause to be installed on any public right-of-way or on property owned by the City, within the City limits of the City, or on privately owned property or property in its possession over which the City has an easement or other right-of-way for the draining of surface waters, any tile, pipe, culvert, or other artificial device for the carrying of surface waters unless and until the City Engineer or some other official of the City designated by the Mayor has approved the materials, diameter, and the construction of such artificial device for the carrying of surface waters.
