No person shall make any opening in or upon any street, alley or sidewalk in the City unless he or she shall first secure permission from the City Public Works Director. Such permission shall be secured by the person making an application and depositing with the City Public Works Director a cash amount to be determined by the City Public Works Director, which amount shall be sufficient to pay any expense which may be incurred by the City in connection with replacing such opening, and particularly the repaving of such opening if such opening is in a paved street, alley or sidewalk; such deposit shall be not less than the most current replacement cost as provided by the Purchasing Director; in no case shall a less charge be made than for a single yard. Such application shall state the time and manner in which the work shall be done.

The amount of money so deposited with the City Public Works Director shall be held by the Public Works Director until he or she is satisfied that the street, alley or sidewalk in which the excavation was made has been put into as good condition as it was before the excavation was made, but in no event shall said money be held longer than six months from the completion of the work.

No excavation shall be filled to a depth of more than eight inches at any time before it is thoroughly compacted. Each layer shall not exceed eight inches before tamping from the bottom of the trench to the top of the opening. Tamping shall by some method which shall have been approved by the City Public Works Director prior to its use. In the case of paved streets, alleys or sidewalks, the opening shall be closed with the same material with which the street is paved.
Where pipe is installed in the opening, it will be necessary to use material of such fineness so that the entire pipe can be entirely surrounded and compacted when the filled material reaches a depth of half the diameter of the pipe. This tamping or rodding shall be done with a two by four or other suitable rod or tamper.

Any person who makes any opening in any street, alley or sidewalk in the City shall protect, guard, barricade and light such opening and shall retamp and replace the surface in as good condition as is reasonably possible, and shall maintain such work in a safe condition for four days from the day that the City Public Works Director's office has been notified that the opening has been closed and replaced and shall be responsible for all accidents that may occur by reason of such opening not being properly maintained. Such person shall report within 12 hours to such office that the opening is closed and replaced.
No person shall make excavation in the streets, alleys and public ways of the City and leave said excavation open or leave material therefrom in the streets at night without having lights placed thereat, and without having same sufficiently barricaded.
The person obtaining the permission to excavate shall make frequent inspections to see that the opening is always in safe condition during the time that he or she is required to maintain the same.
