In expansion of the declaration of legislative intent found in Article I of this chapter and the statement of community development objectives found in Article I, the intent of this article, among others, is as follows:
A. 
Allow flexibility in addressing parking, loading, and access by permitting construction of a reduced number of parking spaces under appropriate conditions.
B. 
Set reasonable standards and provide reasonable controls to ensure sufficient parking capacity for the uses or potential uses of land in the Township.
C. 
Prevent hazards to public safety caused by the intrusion of parking upon public rights-of-way.
A. 
Minimum off street parking facilities required. On any lot on which a building is hereafter erected or substantially altered or used for any of the purposes hereafter set forth or uses similar thereto, there shall be provided, as a minimum, the number of off-street parking spaces as set forth below.
B. 
The parking space requirements by use or multiple uses on a site shall follow the minimum standards found in the table below, unless and until they are modified through the application of the provisions of.
C. 
The applicant may propose a lower number of spaces than otherwise required, provided the applicant provides a parking study or can adequately justify the proposed number of spaces based on shared parking standards from ITE Parking Generation Handbook or the Urban Land Institute.

Utility Uses

A. 
All parking spaces shall be constructed in accordance with the dimensions set forth in Chapter 300, Subdivision and Land Development. The minimum dimensions for all aisles and turning radii shall conform to the standards contained in § 300-17 of Chapter 300, Subdivision and Land Development.
B. 
A motor vehicle garage space or an outdoor parking space (see definition in § 350-13 hereof) shall consist of usable area not less than nine feet wide by 18 feet in length for each motor vehicle, exclusive of maneuvering area, or interior driveways or access roads connecting the parking space with a street, alley or right-of-way. Outdoor parking or service areas for commercial, industrial, institutional, apartment or other multifamily dwelling uses, and the approaches thereto, shall be paved in accordance with the specifications set forth in Chapter 295, Article IV, of the Upper Moreland Township Code and shall be graded, properly drained and maintained in good condition. Lines delineating parking spaces must be painted in such parking areas to show individual parking spaces of the size required hereby, and such painted lines must be properly maintained at all times. Except as restricted by applicable provisions for buffers, landscape areas, impervious coverage ratios and other restrictions in individual zoning districts, outdoor parking areas and approach driveways shall be permitted. See Article IV, Use Regulations, for additional use regulations for structured and surface parking lots.
C. 
All required parking spaces shall be located in the side or rear yard areas.
D. 
Any grading to create or expand parking facilities on a lot shall be consistent with neighboring properties and shall be designed acceptable to the Township in consultation with the Township Engineer.
E. 
Number of curb cuts. Each lot shall have not more than one curb cut per street frontage for a two-way driveway for vehicular access, as subject to the regulations of PennDOT for state highways. If sufficient room is not available for one two-way driveway, the Township may approve two curb cuts for two one-way driveways, subject to the approval of PennDOT.
F. 
Access driveways shall be located as far from a street intersection as feasible.
(1) 
When two or more abutting lots share an access driveway, that driveway shall be designed as the main access to those lots, and one or more existing access driveways shall then be closed.
(2) 
Access easements and maintenance agreements or other suitable legal mechanisms shall be provided when shared access is required or provided, acceptable to the Township in consultation with the Township Solicitor.
(3) 
Liability safeguards for all property owners and lessees served by the shared access shall be guaranteed to the satisfaction of the Township in consultation with the Township Solicitor.
G. 
Maximum parking. No more than 150% of the required minimum parking is permitted.
H. 
Electric vehicle parking. For parking lots or parking structures containing more than 100 spaces, at least three out of every 100 spaces shall be reserved for electric or hybrid vehicles, which may include electric vehicle charging stations.
I. 
Design requirements for parking lots consisting of 50 spaces or more. All parking lots consisting of 50 spaces or more shall be operated and maintained in accordance with all of the following conditions:
(1) 
They shall not be used for the sale, repair or dismantling of any vehicle, equipment, materials, or supplies.
(2) 
They shall be properly graded for drainage; surfaced with concrete, asphaltic concrete, asphalt, or any dust-free surfacing and maintained in good condition, free of weeds, dust, trash or debris.
(3) 
They shall be provided with entrances and exits so located as to minimize traffic congestion and the effect of headlight glare.
(4) 
Parking spaces shall be provided with wheel or bumper guards so located and arranged that no part of any parked vehicles will extend beyond the boundaries of the parking lot.
(5) 
Lighting facilities shall be so arranged that they neither unreasonably nor unnecessarily disturb occupants of adjacent residential properties nor interfere with traffic by either location or glare. A planting strip shall be provided along each property line which is opposite or adjacent to a residential district, except where buildings, driveways, and walkways are located.
(a) 
The planting strip shall be a minimum of five feet in width and shall meet the requirements of screen buffers as regulated by § 300-43C.
(6) 
In addition to any other requirement of this chapter or Chapter 300, Subdivision and Land Development, one shade or canopy tree shall be required for every 40 feet of perimeter surrounding the parking area, including the length of any access driveway(s). Shade or canopy trees shall be distributed throughout the screen buffer and internal planting.
A shared parking agreement allows users an opportunity, if they choose, to redesign parking lots to be more efficient in serving multiple users. This may consist of making new curb cuts between parking lots, restriping lots, or redesigning internal traffic circulation and pedestrian walkways. Shared parking is permitted along or across a common lot line. Any subsequent changes in use shall require reevaluation and approval by the Township.
A. 
Shared parking reductions are available for multiple uses on:
(1) 
Single or multiple adjacent sites under single ownership; and
(2) 
Multiple contiguous sites with a shared parking agreement sharing parking facilities.
B. 
A shared parking agreement, approved by the Township Solicitor, shall be filed with the Zoning Officer.
(1) 
The owner of the shared parking facility shall guarantee availability of the required spaces for the associated use and meet their minimum parking requirement.
(2) 
The shared parking facility may utilize shared parking to reduce the total spaces within the facility in accordance with Table: Shared Parking Calculation.
C. 
Shared parking location. The shared parking facility shall be located within 900 feet, measured from the lot line to the nearest lot line of the parking facility, of the associated use.
D. 
The minimum amount of shared parking required shall be calculated using the peak demand calculations, according to the following formula (See Table: Shared Parking Calculation):
(1) 
Calculate the minimum amount of parking required for each land use as if it were a separate use (including any applicable parking reductions, per § 350-180).
(2) 
To determine peak parking requirements, multiply the minimum parking required for each proposed land use by the corresponding percentage in the table for each of the six time periods.
(3) 
Calculate the column total for each time period.
(4) 
The column (time period) with the highest value shall be the minimum parking requirement.

The parking reduction shall be applied to the overall total number of parking spaces required. The calculation of the minimum parking requirement shall take into account any applicable reductions prior to calculating any shared use parking reduction as provided by § 350-179.
A. 
Availability of on-street parking. The required number of parking spaces may be reduced by the amount of available on-street parking spaces available along the frontage of the property on either side of the street, as determined by the Zoning Officer.
(1) 
If parking spaces are not marked, the applicant shall provide a plan indicating the placement of parallel parking spaces along the property's frontage(s), taking into account areas where parking would not be permissible or feasible.
(2) 
On-street parking spaces along a property's frontage(s) shall remain open to public use and shall not be allocated specifically to the subject property or use.
B. 
Proximity to public parking. The required number of parking spaces may be reduced by 25% if the use is located within 800 feet walking distance from a public parking facility.
C. 
Proximity to rail transit. The required number of parking spaces may be reduced by 25% if the use is located within 800 feet walking distance from a train station.
D. 
Parking reduction for existing nonresidential structures. When an existing nonresidential structure changes in use from one nonresidential use to another nonresidential use, the first 1,000 square feet of gross floor area shall be omitted from the calculation of the minimum parking requirement set forth in § 350-177 when the following conditions are met:
(1) 
The proposed nonresidential use shall be located entirely within an existing structure or portion thereof, which was wholly constructed prior to the effective date of the Zoning Ordinance.
(2) 
If the applicable parking requirement for the new nonresidential is not based on gross floor area, then five parking spaces may be omitted from the minimum parking requirement.
In addition to the required off-street parking spaces for a particular use, on any lot on which a building is hereafter erected, substantially altered, or used as an institution, apartment house, or for any trade, business, industry, restaurant or other food establishment, or for any similar use involving the receipt or distribution of materials or merchandise, there must be provided adequate off-street loading, unloading and waste disposal space with proper access from a street, alley or right-of-way.
A. 
No such loading, unloading and waste disposal space shall be located in the required front yard area.
B. 
Service and loading areas shall be located to the side or rear of the building. No facilities shall be constructed in any required buffer area.
C. 
Service areas and loading docks shall be adequately screened from adjacent streets, pedestrian ways, and properties; and shall be landscaped in accordance with an overall plan designed according to the provisions herein. Loading spaces shall be 12 feet in width, 40 feet in length with 14 feet of vertical clearance.
D. 
Loading areas shall be lit to provide security and safety; however, lighting shall be shielded to prevent glare onto adjacent properties.
A. 
Parking held in reserve. If the number of spaces required by § 350-177 of this article is substantially larger than the number of spaces that the applicant anticipates needing, the number of spaces required to be constructed by this chapter may be reduced and the land area equal to the reduction shall be denoted, "Parking Reserve Area," while ensuring adequate area for potential parking demands. Said reduction may be accomplished only upon full compliance with each of the following standards:
(1) 
The landowner or developer shall certify that the parking needs for the use to which the lot or property is to be devoted are less than those required by the terms of this chapter. When constructed, the reserve parking must meet all of the applicable provisions of this chapter as of the date the construction permit is sought.
(2) 
The parking reserve area created by such reduction shall be clearly set forth and labeled as such on the development, subdivision or other plan required to be filed with the Township.
(3) 
The Township Engineer shall concur with and approve the certification that a lesser number of parking spaces is sufficient.
(4) 
Suitable area shall be reserved for the balance of the total number of spaces required by § 350-177 of this article; these spaces shall be converted to parking area at such time when the landowner or developer further certifies that the need to use such reserve area for parking has arisen or when the Township Engineer, upon review and inspection of the premises in question, certifies to such fact.
(5) 
The applicant shall install stormwater management facilities, as required by the Township, for the total required number of parking spaces, including those held in reserve.
(6) 
This area shall be kept as landscaped lawn area and shall be maintained by the owner or owners of the proposed development but can be used as overflow parking without paving if it can be proven by the applicant that such overflow parking on landscaped areas is infrequent and maintenance of the lawn area will not be disrupted by the overflow parking.
(7) 
The parking reserve area so created shall be utilized as open space and shall be maintained by the owner or owners of the proposed development.
(8) 
If the parking spaces held in reserve are to be paved, the Township strongly recommends the use of grass pavers to maintain the look of a green, landscaped yard and mitigate the increased stormwater runoff.
(9) 
The applicant must agree in a recorded covenant, approved by the Township Solicitor, to install the reserve parking spaces at any future time if and when the Zoning Officer determines that the reserve parking spaces are needed to accommodate the use of the property. The applicant may appeal such order to the Zoning Hearing Board.
A. 
Applicability. Any change of use shall require the installation of the requisite number of bicycle parking spaces pursuant to Subsection B, below.
B. 
Number of bicycle parking spaces required.
(1) 
Bicycle racks shall be placed in strategic locations in visually prominent areas while not interfering with pedestrian flow.
(2)

C. 
Bicycle parking shall be provided near the principal building entrance area, and shall be located according to the following configurations:

D. 
Bicycle parking located along private or public streets is subject to the following:
(1) 
Bicycle racks installed parallel to curbs shall be set back from the curb a minimum of two feet.
(2) 
Bicycle racks installed perpendicular to curbs shall allow for a minimum clearance of two feet at the curb and five feet of sidewalk.
(3) 
Bicycle racks should be spaced a minimum of 36 inches apart.
(4) 
Bicycle racks shall allow bicycle frames to be locked at two points of contact with the rack.
E. 
Long-term bicycle parking shall be covered.
F. 
The Board of Commissioners may, by conditional use, hold in reserve or reduce the number of required bicycle parking spaces, provided the applicant demonstrates that there are ample facilities available for use nearby.
