A Surface Water Management Utility is comprised of the following:
1. 
Natural and man-made surface water facilities and conveyances, e.g., waterways, canal, dams; and
2. 
Man-made stormwater conveyance structures and water-quality facilities.
The City Council finds and declares that absent effective maintenance, operation, regulation and control, existing surface water drainage conditions in all drainage basins within the City constitute a potential hazard to the health, safety and property of the citizens of the City.

The Surface Water Management Utility shall plan, design, construct, maintain, administer and operate all City-owned surface water conveyance structures and water-quality facilities, the regulations for their control as well as establish standards for design, construction, operation, and maintenance.

The City Manager shall be the administrator of the Program.

The following assets are hereby vested in the Surface Water Management Utility: All properties, interests, and physical or intangible rights owned or held by the City insofar as they concern surface water management. These rights include all properties or interests in property acquired by adverse possession or prescription, directly or through another, in the drainage or storage of surface waters via lands and waterways (with the specific exclusion of Oswego Lake), beginning at a point where surface water or stormwater first enters the system of the City and ending at a point where the surface water or stormwater exits from the Surface Water Management Utility, and in width to the full extent of inundation caused by storm or flood conditions.

The City shall adopt, and from time to time amend, a Stormwater Master Plan.
2. 
The Plan shall establish an appropriate level of service for the public stormwater system.
3. 
The Plan shall determine areas of deficiency due to infrastructure capacity, age, or potential for hydromodification and shall prioritize a list of system improvements necessary to address the deficiencies.
