In order to promote and preserve the public health, safety, comfort, welfare and well-being of the inhabitants of the Village and to maintain the orderly entrance and exit of vehicular traffic onto public roads to or from private property, the Board of Trustees of the Village of Wappingers Falls finds that with the increase in population and for the safety of the traveling public within the Village that it is necessary to grant the Village of Wappingers Falls Building Inspector, the Deputy Building Inspector, the Zoning Administrator, Deputy Zoning Administrator, the Fire Chief, the Superintendent of Highways, the Village of Wappingers Falls Police Department and any other Police Officer or Peace Officer, as defined in the New York State Criminal Procedure Law, the authority to enforce parking and traffic regulations on parking areas and driveways of hospitals, shopping centers, office buildings and office building complexes, places of public assembly, facilities owned or leased by not-for-profit corporations, private apartment complexes and fire stations; private condominium complexes; mobile home parks; and manufactured home parks upon the written request of the owner, the person in general charge of the operation and control of such area, the Fire Chief of the Village Fire Department or the Police Chief or the Police Commissioner of the Village of Wappingers Falls Police Department.
In accordance with Section 1640-a of the New York State Vehicle and Traffic Law and pursuant to the written request of the owner, the person in general charge of the operation and control of such area, the Fire Chief of the Village Fire Department or the Police Chief or the Police Commissioner of the Village of Wappingers Falls Police Department, the Village of Wappingers Falls Building Inspector, the Deputy Building Inspector, the Zoning Administrator, Deputy Zoning Administrator, the Fire Chief, the Superintendent of Highways, the Village of Wappingers Falls Police Department and any other Police Officer or Peace Officer, as defined in the New York State Criminal Procedure Law, or their duly appointed designees are hereby authorized to enforce parking and traffic regulations on parking areas and driveways of hospitals, shopping centers, office buildings and office building complexes, places of public assembly, facilities owned or leased by not-for-profit corporations, private apartment complexes and fire stations; private condominium complexes; mobile home parks; and manufactured home parks described in Schedule XXVI as follows:
A. 
Order stop signs, flashing signals or yield signs erected at specified entrance or exit locations to any such area or designate any intersection in such area as a stop intersection or as a yield intersection and order like signs or signals at one or more entrances to such intersection.
B. 
Regulate traffic in any such area, including regulation by means of traffic-control signals.
C. 
Establish maximum speed limits in any such area at not less than 15 miles per hour.
D. 
Prohibit or regulate the turning of vehicles or specified types of vehicles at intersections or other designated locations in any such area.
E. 
Regulate the crossing of any roadway in any such area by pedestrians.
F. 
Designate any separate roadway in any such area for one-way traffic.
G. 
Prohibit, regulate, restrict or limit the stopping, standing or parking of vehicles in specified areas of any such area.
H. 
Designate safety zones in any such areas.
I. 
Designate handicapped parking spaces in any such areas.
J. 
Provide for the removal and storage of vehicles parked or abandoned in any such area during snowstorms, floods, fires or other public emergencies, or found unattended in any such area, where they constitute an obstruction to traffic or where stopping, standing or parking is prohibited, and for the payment of reasonable charges for such removal and storage by the owner or operator of any such vehicles.
K. 
Adopt such additional reasonable rules and regulations with respect to traffic and parking in any such areas as local conditions may require for the safety and convenience of the public or the users of any such area.
It shall be the responsibility of the owners of the aforementioned private property and areas, their successors or assigns, to construct and maintain signs and other markings, at their sole cost and expense, appropriate to identify "Fire Lanes," "Safety Lanes" or areas marked "No Parking" and any other signage or traffic control device required pursuant to an approved site plan approved by the Village of Wappingers Falls Planning Board. Said signs shall conform to the uniformed standards prescribed by the New York State Department of Transportation to the extent provision is made for such signs. Fire lanes shall be located in those areas designated by the Fire Inspector and/or Fire Chief in whose jurisdiction such lanes lie.
The regulation of traffic and parking on private roads, parking areas and driveways pursuant to this article shall in no way obligate the Village of Wappingers Falls, New York, its employees, representatives, officers or agents to otherwise maintain, regulate, operate, repair, construct, reconstruct or in any other manner be responsible for any private road, parking areas or driveway within the Village.
A. 
Village of Wappingers Falls Building Inspector, the Deputy Building Inspector, the Zoning Administrator, Deputy Zoning Administrator, the Fire Chief, the Superintendent of Highways, the Village of Wappingers Falls Police Department and any other Police Officer or Peace Officer, as defined in the New York State Criminal Procedure Law, or their duly appointed designees, may cause a vehicle to be removed, immobilized and/or stored in accordance with Article IV, Removal, Immobilization and Storage of Vehicles, within this chapter.
In addition to the authority to remove, immobilize and store vehicles as set forth in Article IV of this chapter, the Village of Wappingers Falls Building Inspector, the Deputy Building Inspector, the Zoning Administrator, Deputy Zoning Administrator, the Fire Chief, the Superintendent of Highways, the Village of Wappingers Falls Police Department and any other Police Officer or Peace Officer, as defined in the New York State Criminal Procedure Law, or their duly appointed designee, shall be authorized and empowered to issue or cause to be issued an appearance ticket returnable in the Justice Court of the Village of Wappingers Falls, or any other court of competent jurisdiction, for a violation of any of the provisions set forth in in this Article or any traffic, parking, standing or stopping regulations set forth in Chapter 143 of the Village of Wappingers Falls Village Code.
Any owner or person operating any vehicle on private property in violation of this article or any traffic, parking, standing or stopping regulations provided for in Chapter 143 of the Village of Wappingers Falls Village Code shall be subject to the fines and penalties set forth therein.
