[HISTORY: Adopted by the Borough Council of the Borough of Evans City 1-2-2024 by Ord. No. 1-2024. Amendments noted where applicable.]
A Public Safety Department (hereinafter referred to as the "Department") is hereby established for Evans City Borough. The Department shall be responsible for maintaining public safety and order within the Borough limits, encompassing the following functions:
A. 
Law enforcement: enforcing all laws and ordinances, conducting investigations, making arrests, providing police services, and promoting community engagement.
B. 
Emergency response: coordinating and responding to fire, medical, and other emergency situations within the Borough, in collaboration with relevant services.
C. 
Emergency preparedness: developing and implementing emergency preparedness plans, conducting disaster drills, and coordinating public education efforts.
All other ordinances and resolutions or parts thereof as they are inconsistent with this chapter are hereby repealed (Ordinance No. 557, effective January 1, 2015).
The Department shall comprise a Director of Public Safety, part-time police officers, and other necessary personnel as determined by the Borough Council.
A. 
The Department shall be led by a Public Safety Director, appointed by the Borough Council, that will oversee all operations of the Department.
B. 
The Public Safety Director shall be responsible for the overall operation and administration of the Department, including maintaining liaison with other public safety agencies and governmental entities.

The Law Enforcement Division shall be led by the Public Safety Director responsible for managing police officers, as the Council from time to time may appoint.
B. 
The Department may employ part-time police officers as necessary.
C. 
Duties, hours, and conditions of employment for part-time officers will be determined in accordance with Borough needs and budget constraints.
D. 
The Law Enforcement Division shall be responsible for enforcing all laws and ordinances within the Borough limits, conducting investigations, making arrests, and providing police services to the community.
The terms, conditions and provisions of this chapter are hereby declared to be severable, and, should any portion, part or provision of this chapter be found by a court of competent jurisdiction to be invalid, nonenforceable or unconstitutional, the Council hereby declares its intent that this chapter shall have been enacted without regard to the invalid, nonenforceable, or unconstitutional portion, part or provision of this chapter.
This chapter shall take effect and be in force on the earliest date permitted by the Borough Code, but no sooner than January 1, 2024.
