Except as otherwise specifically provided for, certain words and terms as used in this Chapter 281, Food and Food Establishments, shall have the meanings ascribed to them in this article.
Means the condition of a food:
If it bears or contains any poisonous or deleterious substance in a quantity which may render it injurious to health.
If it bears or contains any added poisonous or deleterious substance for which no safe tolerance has been established.
If it contains in whole or in part of any filthy, putrid or decomposed substance, or if it is otherwise unfit for human consumption.
If it has been processed, prepared, packed or held under unsanitary conditions, whereby it may have become contaminated with filth, or whereby it may have been rendered injurious to health.
If it is in whole or in part the product of a diseased animal which had died otherwise than by slaughter.
If its container is composed in whole or in part of any poisonous or deleterious substance which may render its contents injurious to health.
Means a material which maintains its original surface characteristics under prolonged influence of the food, cleaning compounds and sanitizing solutions which may be in contact with it.
Means the Board of Health and its duly authorized agents.
Means readily accessible and of such materials and finish, and so fabricated that residue may be completely removed by normal cleaning methods.
Means an establishment where food or drink is prepared or served for consumption on or off the premises, including such establishments as a restaurant, buffet, lunchroom, grill, coffee-shop, cafeteria, short-order cafe, soda fountain, in-plant feeding establishment, institution food establishments, private clubs, catering establishments and commissaries supplying vending machines, mobile eating and drinking establishments and semimobile food establishments.
Includes any cook, waiter, kitchen help or other persons of any kind employed in an eating or drinking place who in any manner whatsoever handles or comes in contact with any food or drink served to or provided for the public, and the proprietor or any member of the proprietor's family who handles such food or drink.
Means all stoves, ranges, hoods, meatblocks, tables, counters, refrigerators, sinks, dishwashing machines, steam tables and similar items other than utensils used in the operation of a food service establishment.
Means any raw, cooked or processed edible substance, beverage or ingredient intended in whole or in part for human consumption.
Means those surfaces of equipment and utensils with which food normally comes in contact, and those surfaces with which food may come in contact, or which drain back onto surfaces normally in contact with food.
Includes retail food establishments, mobile food establishments, temporary eating and drinking establishments, and eating and drinking establishments, milk wholesalers and retailers, and meat wholesalers.
Means all putrescible wastes, except sewage and body waste, including animal and vegetable offal.
Means any meat processor that conducts a wholesale business in the City.
Means any milk processor that conducts a wholesale or retail business in the City.
Shall be any vehicle from which food is sold. Such vehicle must be a self-contained vehicle having no food of any kind sold from any fixed stand or other temporary or permanent fixture located on the public street or sidewalk or any private property, which stand or other fixture is off or outside the physical confines of such vehicle.
Means any perishable food which consists in whole or in part of milk or milk products, eggs, meat, poultry, fish, shellfish or other ingredients capable of supporting rapid and progressive growth of infectious or toxigenic micro-organisms.
Means any person, partnership, association or corporation conducting or operating a food establishment within the City.
Means all nonputrescible wastes generally regarded and classified as rubbish, trash, junk, ashes and similar designations.
Means any place, whether temporary or permanent, stationary or mobile, where food or drink is packaged, stored, served, sold or offered for sale directly to the consumer.
Applies to potentially hazardous food and means an internal and external temperature of 42° F. or below, and 140° F. or above.
Means effective bactericidal treatment of clean surfaces of equipment and utensils by a process which has been approved in this chapter as being effective in destroying microorganisms, including pathogens.
Shall be any stand that is not of a permanent nature and must be completely removed daily. A semimobile food establishment may only sell either at retail or wholesale produce and/or vegetables; the sale either at wholesale or retail of any potentially hazardous food such as milk, meat, fish, etc., is strictly prohibited.
Means any substance that contains any of the waste products or excrements or other discharge from the bodies of human beings or animals and any noxious or deleterious substance being harmful or inimical to the public health, or to animal or aquatic life, or to the use of water supply or for recreation.
Means any system whether community or individual, publicly or privately owned, for the collection and disposal of sewage or industrial wastes of a liquid nature, or both, including various devices for the treatment of such sewage or industrial wastes.
Mean cups, containers, lids or closures; plates; knives, forks, spoons, stirrers, paddles; straws, place mats, napkins, doilies, wrapping materials and all similar articles which are constructed wholly or in part from paper, paperboard, molded pulp, foil, wood, plastic, synthetic or other readily destructible materials, and which are intended by the manufacturers and generally recognized by the public as for one usage only, then to be discarded.
Means any public eating or drinking establishment which operates at any location for a temporary period of time not to exceed more than 14 consecutive calendar days, regardless of whether the establishment operates continuously during this time, in connection with a fair, carnival, circus, public exhibition or similar transitory gathering.
Mean any tableware and kitchenware used in the storage, preparation, conveying, consumption or serving of food.
Means a source or sources of water, as well as any and all water treatment, storage, transmission and distribution facilities.
