As used in this chapter, certain words are defined as follows:
CITY
Means the City of Chester, Pennsylvania.
DISPOSAL
Means the storage, transfer and/or processing or reprocessing of chemicals and/or other wastes that are hazardous.
HAZARDOUS WASTE
Means any chemical or other waste, natural or man-made, which has the potential to harm man, mankind and/or the environment. This includes all hazardous waste which the United States Environmental Protection Agency and/or the Pennsylvania Department of Environmental Resources determines is hazardous. Following is a partial list of hazardous waste to be regulated by this chapter:
A. 
Polychlorinated biphenyls (PCBs).
B. 
Pesticide wastes.
C. 
Cyanides.
D. 
Heavy metals.
E. 
Phenols.
F. 
Hexachlorobenzene (HCB).
G. 
Hydrogen sulfide.
SITE
Means a single geographic location that is confined by natural and/or man-made barriers.
All licensees under this chapter shall keep accurate records of all hazardous waste which they receive. These records shall include the following:
A. 
Hazardous waste source including name and address it came from and the hauler.
B. 
Types.
C. 
Quantities.
D. 
Waste disposition, including names and addresses of transfer agents and sites.
E. 
Dates and times shall be included for information required by Subsections A to D hereof.
A. 
No person, partnership or corporation shall store, transfer, process or reprocess hazardous waste within the City except when authorized through possession of a currently validated license from the Bureau of Health in the Department of Public Safety for such purposes. Any person, partnership or corporation in possession of a valid disposal license who fails to comply with the provisions of this chapter may have such license either revoked or suspended by the Bureau of Health. At any time during the licensing period, inspections shall be made of all disposal licensed sites as frequently as necessary to insure compliance with this chapter.
B. 
All licenses shall expire on May 1 of each year.
C. 
All licensing or permit requirements by the United States Environmental Protection Agency and the Pennsylvania Department of Environmental Resources shall be met prior to the issuance of a license by the Bureau of Health.
D. 
The Bureau of Health shall coordinate inspections with the United States Environmental Protection Agency and the Pennsylvania Department of Environmental Resources whenever the Bureau deems it necessary.
E. 
The Bureau of Health shall not issue a license under this chapter until the application has been approved by Council.
F. 
The license is not transferable.
G. 
The license shall be displayed at all times prominently on the licensed site within the City.
H. 
A license shall be obtained for each site.
A. 
Hazardous waste license and inspection fees shall be as follows:
(1) 
License fee: $500.
(2) 
Inspection fee (for each inspection): $50.
B. 
Inspection fees shall commence upon the applicant applying for a license under this chapter.
C. 
Duplicate licenses may be obtained for a fee of $5.
D. 
A late fee of $5 shall be charged for those license renewal applications received after May 1.
The Board of Health may from time to time present to Council such suggested rules and regulations as it deems necessary for the proper enforcement of the provisions of this chapter, provided that such rules and regulations shall not be in conflict with the provisions of this chapter. Council may, by ordinance, approve and adopt such rules and regulations or any of them. Such rules and regulations so approved and adopted shall have the same force and effect as the provisions of this chapter, and the penalty for violation thereof shall be the same as the penalty for the violation of the provisions of this chapter.

Any person, partnership or corporation who violates any provision of this chapter or any provision of any rule or regulation adopted by the Board of Health and Council pursuant to the authority granted by this chapter shall, upon conviction in a summary proceeding, be fined not more than $1,000 and costs, and in default of payment thereof, shall be imprisoned not more than 90 days. Each day's violation of any of the provisions of this chapter or the rules or regulations as aforesaid shall constitute a separate violation hereof.
