The short title of this chapter shall be the "City of Chester Water Conservation Ordinance," and the same may be cited in that manner.
The purpose of this chapter is to conserve and protect its water supply for the greatest public benefit and reduce excessive water waste by establishing minimum standards for all plumbing fixtures and fittings installed, altered or extended after the adoption of this section.
No water shall be provided for internal or external use to any residential, commercial, industrial, agricultural, recreational, governmental, or public building or structure of any kind which is constructed or remodeled and in which plumbing, water piping or water fixtures are to be installed, extended or altered in any way, and for which a permit is required to be obtained from the City of Chester unless the new, extended or altered plumbing, water piping and other water using fixtures therein conform to the requirements and standards of § 542-4. The provisions of this chapter shall apply to any building or structure for which a building permit is issued, or would otherwise be required to be issued but for an exemption, on or after the date of adoption hereof.
A. 
Water closets and associated flushing mechanisms. The water consumption of water closets shall not exceed an average of 1.6 gallons per flush cycle over a range of test pressures from 20 to 80 pounds per square inch (psi). The fixture shall perform in accordance with the test requirements of the American National Standard Institute (ANSI) A112.19.2M and (ANSI) A112.19.6M.
B. 
Urinals and associated flushing mechanisms. Urinal water consumption shall not exceed an average of 1.5 gallons per flush cycle over a range of test pressures from 20 to 80 pounds per square inch (psi). The fixtures shall perform in accordance with the test requirements of ANSI A112.19.2M and ANSI A112.19.6M.

Showerheads. Showerhead discharge rates shall not exceed 3.0 gallons of water per minute over a range of test pressures from 20 to 80 pounds per square inch (psi). The fixture shall perform in accordance with the test requirements of ANSI A112.18.1M.
D. 
Faucets. Sink and lavatory faucet discharge rates shall not exceed 3.0 gallons of water per minute over a range of test pressures from 20 to 80 pounds per square inch (psi). The fixture shall perform in accordance with the test requirements of ANSI A112.18.1M.
A. 
Special purpose equipment. The performance standard of § 542-4 shall not apply to fixtures and fittings such as emergency showers, aspirator faucets and blowout fixtures that, in order to perform a specialized function, cannot meet the specified standards.
B. 
Exemptions. Any person(s) may apply to the City of Chester for an exemption to the terms of this chapter, which may be granted by the Director of the Department of Public Safety, upon proof that some other device, system or procedure will save as much or more water as those set forth herein, or that those set forth herein cannot be complied with, without undue hardship.
The Director of the Department of Public Safety or his/or her designate is authorized and directed to enforce this chapter. The Director is hereby authorized and directed to establish and promulgate reasonable rules and regulations in accordance with the terms hereof and any other matter required to implement this chapter. All such rules or regulations shall be submitted to and approved by Council.
Any person who violates any provision of this chapter or fails to comply therewith or with any of the requirements thereof, or who installs, extends, alters or repairs any water piping or other water or plumbing fixtures or fitting in violation hereof, shall upon conviction before a District Justice of the Peace, be fined not more than $1,000 and in default of payment thereof, shall be imprisoned not more than 90 days. Each day's failure to comply with a rule, regulation, direction or order of the Director of the Department of Public Safety shall constitute a separate violation. Anyone who may have assisted in the commission of such violation shall each be guilty of a separate offense punishable as provided herein.
