Certain words as used in this article are defined as follows:
BUILDING
Means any structure containing a heating unit within the City.
EMERGENCY SHUTDOWN SWITCH
Means a switch that will cause the heating unit to shut off.
HEATING UNIT
Means any device or boiler, except gas heaters, used for the purpose of creating heat for any purpose regardless of the fuel used by the unit.
SINGLE-FAMILY DWELLING
Means occupancy where a living unit is occupied by the members of one family.
A. 
New construction. All new buildings hereinafter constructed in the City shall be equipped with an emergency shut down switch on all heating units installed in such building.
B. 
Existing structures. All existing structures, with the exception of single-family dwellings used as an owner's residence, shall be equipped with an emergency shut down switch within one year from the date of this section.
C. 
Single-family dwellings. Single-family dwellings used as an owner's residence shall be equipped with an emergency shut down switch prior to the transfer of legal ownership of such property.
D. 
Certificate of occupancy. Any structure for which a Certificate of Occupancy is required shall contain an emergency shut down switch as provided herein prior to the issuance of a Certificate of Occupancy.
E. 
Location. All emergency shutdown switches shall be installed at the top of the basement stairs if the heating unit is located in the basement. If the heating unit is located anywhere other than the basement, the emergency cutoff switch shall be located outside the heating unit room. Any location other than those specified herein shall receive prior approval from the Director of Public Safety.
F. 
Switch markings. All emergency shutoff switches shall be mounted with a red switch plate containing the words "EMERGENCY HEAT SHUTOFF" in conspicuous lettering.
G. 
Exceptions. Heating units utilizing gas fuel are exempted from compliance with this article.
The Director of Public Safety and/or his duly authorized agent shall ensure the proper compliance with this article.
This article creates no legal liability to the City other than to insure that at the time of inspection the shutdown device was present and functional.
Any person, partnership or corporation who violates any provision of this article shall, upon conviction before any District Justice, be fined not more than $1,000 or, in default thereof, imprisoned not more than 90 days. Each day's violation of any of the provisions of this article constitutes a separate violation hereof.
