The purpose of this article is to ensure, to the best of its ability, that any fire extinguisher sold, traded, loaned or given away is in proper working order.

The following words, terms and phrases, when used in this article, shall have the meaning ascribed to them in this section, except where the context clearly indicates a different meaning:
Means a natural person or any company, corporation, or other business entity.
A person shall not knowingly sell, trade, loan or give away any form, type or kind of fire extinguisher which is not in proper working order, or the contents of which do not meet the requirements of the Fire Code, or which is not approved by the Fire Code Official. The requirements of this section shall not apply to the sale, trade or exchange of obsolete or damaged equipment for junk when such units are permanently disfigured or marked with a permanent sign identifying the unit as junk.
Any person violating any provision of this article shall, upon conviction in a summary proceeding, be fined not more than $1,000 and costs and, in default of payment thereof, shall be imprisoned not more than 30 days. Each instance shall constitute a separate violation.
