As used in this article, certain terms are defined as follows:
DETECTOR
Means a detector of the products of combustion (smoke) and not a heat detector. The detector shall be capable of sensing visible or invisible particles of combustion, and shall produce an audible alarm signal within the building for the purpose of notifying the occupants thereof of a fire so they may evacuate the premises. The detector shall meet UL-217 specifications for detector performance.
MULTIPLE OCCUPIED DWELLINGS
Means occupancies where there are three or more living units, including but not limited to apartment houses, tenements, garden apartments, hotels, motels, convents and rectories within the City.
POWER SOURCE
A. 
BATTERYMeans the power supply shall be for one year life including routine testing and shall provide a distinctive audible trouble signal before the battery is incapable of operating for alarm purposes; or
B. 
PERMANENTLY WIREDMeans a proper unswitched circuit. All electrical systems designed to be installed by other than a qualified electrician shall meet the requirements as defined in Article 706 of the National Electrical Code, National Fire Protection Association Bulletin number 70-1975 (Fire Protective Signaling Systems) for the purpose of installation and maintenance only, the applicable section of the National Fire Protection Association Bulletin number 74 "standard for the installation, maintenance, and use of household fire warning systems" shall be considered acceptable engineering practices.
SINGLE-FAMILY DWELLING
Means occupancy where a living unit is occupied by the members of one-family, including occupancies of the same description where rooms are rented to outsiders, not accommodating more than three persons.
TWO FAMILY DWELLINGS
Means occupancy where the living units are occupied by two separate families with independent cooking, sleeping and bathroom facilities.
A. 
All single-, two- or multiple-occupancy dwellings hereinafter constructed shall be equipped with an approved automatic detection device therein as provided herein prior to the issuance of a certificate of occupancy.
B. 
All new owners of single, two or multiple occupancy dwellings shall install an approved automatic detection device therein as provided herein whenever there is a change in the legal ownership of such structure and prior to the issuance of a certificate of occupancy.
A. 
In each single-, two- and multiple-family dwelling, there shall be a minimum of one automatic detection device per floor. A basement shall be considered one floor.
B. 
Each required detection device shall be mounted on the ceiling, or on a wall not more than 12 inches from the ceiling, at a point centrally located in a corridor or area giving access to rooms used for sleeping purposes.
C. 
In a dwelling unit with more than one level, such device shall be centrally located on the ceiling or on the wall of the main room. Where sleeping areas are on an upper level, such device shall be placed at the center of the ceiling directly above the stairway.
A. 
Installation. It shall be the duty of the owner and/or landlord to install a detector device in accordance with the provisions of this article.
B. 
Maintenance. It shall be the duty of each occupant and/or tenant to maintain the detection device in proper operating condition at all times.
The Director of the Department of Public Safety and/or his duly authorized agent shall insure the proper compliance of the sections of this article.
This article creates no legal liability to the City other than to insure that at the time of inspection, the detection device was present and functional.

Any person, partnership or corporation who violates any provision of this article shall, upon conviction in a summary proceeding, be fined not more than $1,000 and costs and, in default of payment thereof, shall be imprisoned not more than 90 days. Each day's violation of any of the provisions of this article constitutes a separate violation hereof.
