The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
BOAT
Includes every vessel propelled in any manner other than by hand. "Boat" shall not be deemed to include public vessels of the United States or of the state or any municipality in the state.
CHANNEL SYSTEM
Includes main channels, cross channels connecting with them, basins and bathing areas.
JET SKI
Means mechanically propelled recreational watercraft.
OWNER
Includes the person under whose name the boat was last registered with the United States Coast Guard or other registration authority having jurisdiction and in any other case the last known owner or the person who claims lawful possession of the boat by virtue of legal title or equitable interest in the boat which entitles him to such possession.
SKIN DIVING
Means any person swimming underwater with the intent to explore or photograph in local waters or to hunt fish in such waters including any person using any self-contained underwater breathing apparatus commonly known as an aqualung. "Skin diving" shall not include bona fide salvage operations displaying proper signals.

It is declared and found that the operation of boats in the water or waterways of the village is a matter affecting the public interest and consequently should be subject to the supervision and administrative control of the village for the purpose of safeguarding the public.

This article shall, except when prohibited by the laws of the United States, apply to all waters or waterways in the village and to all waters or waterways adjacent to the village for a distance of one thousand five hundred (1,500) feet from the shore, provided that they shall not apply to water or waterways in the channel system, if any, under the supervision of the Long Island State Park Commission.

All provisions of the Navigation Law of the inland rules enacted by Congress and governing the navigation of the inland waters of the United States and of the pilot rules for United States inland waters applicable to the channel systems relative to the rules for boats passing each other, as to lights on vessels and as to other matters consistent with the proper use of the channel system shall be complied with by all boats navigating channel systems.

The county police department may enforce the provisions of this article, and every person in charge of a boat navigating or using the waterways of the village shall at all times obey the lawful orders of the members of such police department. Such officers may stop any boat navigating or using the waterways of the village for the purpose of enforcing this article.

Nothing contained in this article shall prohibit the board of trustees from issuing special permits for aquatic events, boat races or otherwise under proper supervision in limited areas for limited periods after prior approval of the United States Coast Guard.

(a) 
Every person operating a boat shall at all times operate the boat in a careful and prudent manner and at such a rate of speed as not to disturb the reasonable comfort or endanger the property of another or the life or limb of any person or so as to interfere with the free and proper use of the waters of the channel.
(b) 
No boat shall be operated in such a manner as to throw up a wake which is dangerous to life or limb of a person, boat or other property.
(c) 
No person shall operate a boat while under the influence of alcoholic beverages or narcotic drugs or opiates.

(a) 
No boat shall be operated at a greater speed than five (5) miles per hour within one thousand five hundred (1,500) feet of shore, except where a channel approaches the shoreline closer than one thousand five hundred (1,500) feet.
(b) 
No boat shall cruise or be operated within one hundred (100) feet of any lifeline or bathing float or, if there is no lifeline or bathing float, then within one hundred fifty (150) feet of any public or semipublic beach regularly used for bathing or swimming. This subsection does not apply to hand-propelled boats.
(c) 
No boat shall cruise or be operated in excess of five (5) miles per hour within fifty (50) feet of any person bathing or swimming except at inlets or where a channel approaches the shoreline closer than one-fourth statute mile.
(d) 
No person operating a boat shall use a searchlight in any manner so as to annoy or disturb other persons or boats.

(a) 
Boats shall not moor or anchor in any channel, and no vessel shall moor to or anchor within fifty (50) feet of any channel marker or so as to interfere with the full use of the channel.
(b) 
Boats shall not moor or anchor so as to endanger the safety of or cause damage to any boat previously anchored or moored, nor so as to interfere with the mooring of any boat previously laid down. Each boat so moored or anchored shall be removed by the owner or person in charge of the boat on order of the board of trustees or any duly authorized officer or agent thereof or member of the county police department. If the boat is not removed after orders to so remove it, it may be removed by or at the direction of the board of trustees or any duly authorized officer or agent thereof of by any member of the police department of the county at the expense of the owner or person in charge of such boat. Such expense may be recovered by a civil action.

(a) 
No person shall operate a boat for towing a person on water skis, a surfboard or similar device unless there is in such boat or vessel a person of at least ten (10) years of age, other than the operator, in a position to observe the progress of the person being towed.
(b) 
No person shall ride on water skis, a surfboard or similar device or use or operate a boat to tow a person on water skis, a surfboard or similar device between the period from one (1) hour after sunset to one (1) hour after sunrise.
(c) 
No person shall ride on water skis, a surfboard or similar device or use or operate a boat to tow a person on water skis, a surfboard or similar device in any channel or within one hundred fifty (150) feet of any public or semipublic bathing beach or public dock or within fifty (50) feet of any swimmer or bather or boat anchored or moving, nor shall any person engaged in such activities come within five hundred (500) feet of the shoreline unless he approaches or departs perpendicular to the shoreline and solely for the purpose of commencing or ending the ride.
(d) 
No person shall ride on water skis, a surfboard or similar device without wearing a life preserver, life belt or similar device, except as a paid performer in a professional exhibition.

No person shall operate a boat propelled wholly or partly by an engine operated by gas, gasoline, naphtha, diesel oil or other substance without having the exhaust from the engine run through a muffler or so controlled by the introduction of water into the exhaust pipe or line so as to muffle the noise of exhaust in a reasonable manner.

(a) 
No skin diving shall be undertaken in any fairway or channel or in any waters where the skin diving may interfere with reasonable and proper operation of boats or within one hundred fifty (150) feet of any public or semipublic beach regularly used for bathing and swimming or within fifty (50) feet of any person bathing or swimming.
(b) 
No person shall engage in skin diving without displaying the international diving flag or authorized skin diving flag of suitable size consisting of a red flag with a diagonal white stripe adequately displayed by float, buoy or boat at all times, and no person shall engage in skin diving without a person of suitable age and discretion, other than the skin diver, in a position as lookout.
(c) 
No person shall use, operate or discharge underwater any spear gun or similar apparatus within one hundred (100) feet of any beach regularly used for bathing or swimming or within fifty (50) feet of any bather or swimmer.
(d) 
No boat or vessel shall operate within fifty (50) feet of any area marked for skin diving by the placement of the regulation red flag.

No person shall launch a jet ski from any dock, ramp or shoreline or operate a jet ski upon any waters or waterways within the village.

Any boat which becomes a menace to navigation or unseaworthy or sinks, grounds or becomes otherwise disabled shall be removed by the owner or person in charge of the vessel on order of the board of trustees or any duly authorized officer or agent thereof. If the boat is not removed after orders to remove it, it may be removed by or at the direction of the board of trustees or any duly authorized officer or agent thereof at the expense of the owner or person in charge of the boat. Such expense may be recovered in a civil action.
