No person shall consume, ingest or take internally any alcoholic beverage as defined in the Alcoholic Beverage Control Law or have in his possession an open container containing any amount of such beverage with an intent to consume, ingest or take internally the alcoholic beverage upon any road, highway or public property owned or controlled by the village or while in a place open to the general public within the village, including any public hall, park or any other public place. This section shall not apply where alcoholic beverages are licensed to be served or when the board of trustees or mayor has, in writing, given specific written permission to serve or consume alcoholic beverages or within a village marina if consumed upon a boat tied up at its properly licensed space.

No person shall appear or be upon any street, sidewalk, highway or in any public hall, park or other public place in the village in a condition of intoxication.

No person shall cause a disturbance in any omnibus or other public conveyance by running through it, climbing through windows or upon the seats or otherwise annoy passengers or employees in such omnibus or other public conveyance.

No person shall refuse to obey the orders of any person in authority, including, but not limited to, code enforcement officers, with respect to the use of or conduct in village property including parks, parking lots or sidewalks.

(a) 
Public places. No person shall throw or deposit any handbill or other advertising material in or upon any sidewalk, street, park or other public place within the village.
(b) 
Inhabited private premises. No person shall throw, deposit or distribute any handbill at or upon private premises except by handing or transmitting any such handbill or advertising material directly to the owner, occupant or other person then present in or upon such private premises. The provisions of this sub-section shall not apply to the distribution of mail by the United States nor to newspapers subscribed to by the owner or occupant of the premises, except that newspapers subscribed to by the owner or occupant of the premises shall be placed on private property in such a manner as to prevent their being carried or deposited by the elements upon any street, sidewalk, park or other public place or upon private property.

No person shall post or affix any notice, poster or other paper or device calculated to attract the attention of the public to any lamppost, public utility pole or shade tree or upon any public structure or building, except as may be authorized or required by law.

A person is guilty of disorderly conduct when, with intent to cause public inconvenience, annoyance or alarm, or recklessly creating a risk thereof:
(1) 
He engages in fighting or in violent, tumultuous or threatening behavior;
(2) 
He makes unreasonable noise;
(3) 
In a public place, he uses abusive or obscene language, or makes an obscene gesture;
(4) 
Without lawful authority, he disturbs any lawful assembly or meeting of persons;
(5) 
He obstructs vehicular or pedestrian traffic;
(6) 
He congregates with other persons in a public place and refuses to comply with a lawful order of the police to disperse; or
(7) 
He creates a hazardous or physically offensive condition by any act which serves no legitimate purpose.

No person shall smoke tobacco products and/or marijuana, carry lighted cigarettes, cigars and/or cigarillos, or use pipes, electric cigarettes, vape pens, vapors, e-liquids, or other legal marijuana instruments at Village Hall Park, Osborn Park, Bandshell Park, Ho Hum Beach, Mothers Beach, and all playground areas within the Village of Bellport.

(a) 
All persons, companies or corporations that require a home improvement license from the County of Suffolk to conduct or engage in any home improvement business shall be prohibited from operating gas- or diesel-powered leaf blowers and hedge trimmers Monday through Friday before 8:00 a.m. and after 6:00 p.m., on Saturdays, Sundays and federally recognized holidays.
(b) 
An application for a permit for relief from this section on the basis of an emergency may be made to the Village Clerk. Any such application shall set out clearly the conditions describing the emergency so alleged. Any permit for relief issued under this section shall be subject to any and all conditions set forth by the Village Clerk.
