The village maintains and provides a number of facilities and services that have either been established by, or are currently maintained by, the village and its residents. Such facilities and services include, but are not limited to: the community center, the marina, "Ho-Hum" and "Mothers" beaches, the golf course and tennis courts, the ferry, parks and the various community and children's programs administered by the village.
The board finds that the recreational facilities and services provided by the village are: (1) generally, in great demand and; (2) have increased seasonal visitation in the village by persons who are, in part, attracted to the village by the availability of such facilities and services.
The board further finds that the absence of a uniform definition of who is authorized as a resident to use such facilities and services has led to situations where use of the facilities and services by persons not residing within the village have deprived bona fide village residents of the use said facilities or services.
Accordingly, it is the intent of the village board to establish a uniform definition of the term 'resident' as that term applies to the use of village recreational facilities and services; to provide for a means of residency determination; and to set parameters on the use of village recreational facilities and services by persons who visit the village on a seasonal basis.

RECREATIONAL FACILITIES AND SERVICES
Shall be defined as all properties owned by, or services or programs administered by, the village which are related to recreation or education and which include but are not limited to: the community center, the marina, "Ho-Hum" and "Mothers" beaches, the golf course and tennis courts, the ferry, parks and the various community and children's programs administered by the village.
RESIDENTIAL REAL PROPERTY
Shall be defined as any legal building, or room or apartment in a building, which is habitually used as a dwelling for sleeping purposes and which is authorized by the applicable zoning designation for use or occupation as a dwelling for sleeping purposes.
RESIDENT IDENTIFICATION CARD
Shall be defined as n identification card issued by the village clerk, stating that the holder thereof is a resident of the village and is entitled to use the villages recreational facilities and services. A nominal processing fee may be established by resolution of the village board.
SEASONAL INHABITANT
Shall be defined as any person who:
(1) 
Intends to reside within the village for a period of less than four (4) consecutive months and who has shown such proof, and paid such fees, as are required by the village, to qualify to use village facilities and services, and
(2) 
Routinely uses residential real property for sleeping purposes pursuant to written lease for the premises and has paid the required fee for entitlement to use village recreational facilities or services, and
(3) 
Has provided to the village clerk an affidavit signed by the owner of the residential real property which is being rented acknowledging the rental agreement and the name and number of members of the renter's household, and
SEASONAL INHABITANT IDENTIFICATION CARD
Shall be defined as an identification card that is issued by the village clerk and entitles the holder thereof to use the village's recreational facilities and services for a specified period of time.

(a) 
A "resident" shall in all cases be a natural person, and further defined as:
(1) 
An owner of residential real property within the village, and members of their household, who routinely use such property for sleeping purposes, and with the intention of using the premises as a primary or secondary dwelling and not as a guest or visitor and where such property is not rented to others in excess of four (4) months per year.
(2) 
A lessee or renter of residential real property within the village, and members of their household, who routinely use such property for sleeping purposes, and with the intention of using the premises as a primary or secondary dwelling and not as a guest or visitor, for in excess of four (4) months of the year and who have provided to the village clerk an affidavit signed by the owner of the residential real property acknowledging the rental or lease of such property.
(3) 
A non-resident owner of vacant residential real property within the village, which vacant real property can "as of right" be improved upon with the addition of a single-family dwelling.
(b) 
A "commercial non-resident tax payer" shall be a natural person, corporate or other legal entity, and further defined as:
(1) 
An owner of real property not located in a residential district within the village provided, said real property is improved upon and which said improvements are authorized by the applicable zoning designation for use or occupancy. Vacant parcels are specifically excluded from "commercial non-resident tax payer" status under this chapter.

(a) 
Residency determinations shall be made by the village clerk, or his designee, and shall be made on such information as the clerk requires. The clerk is authorized to request such additional information as he believes necessary. An applicant's failure to provide any requested information shall be, of itself, sufficient grounds for the clerk to deny the application.
(b) 
An appeal of any residency determination may be made to the village board, and shall be heard at the village board meeting next scheduled from the date of receipt of a written demand for appeal by the village clerk's office. An appeal of the village clerk's determination on residency must be by written request, and filed with the village clerk within thirty (30) days of the clerk's determination.

(a) 
All residents, having resided within the village for, at least, four (4) consecutive months shall be entitled to apply for a resident identification card, which shall be valid for time period established by resolution of the village board to use all village board to use all village facilities and services, including, but not limited to:
(1) 
Community center;
(2) 
Marina;
(3) 
"HoHum" and "Mothers" beaches;
(4) 
Golf course;
(5) 
Tennis courts;
(6) 
Ferry;
(7) 
Launch ramp;
(8) 
Parks;
(9) 
Various community programs; and
(10) 
Children's programs, including the children's camp.
(b) 
A commercial non-resident taxpayer and a non-resident owner of residential property as defined by subsection 24-3(c) above shall be considered a resident of the village for use of the village amenities set forth below. Under no circumstance does this privilege allow for either the commercial non-resident tax payer or non-resident owners of residential property as defined in subsection 24-3(c) above to apply for a boat slip at the village dock. This privilege extends to the commercial non-resident taxpayer or non-resident owner of residential property as defined by subsection 24-3(c), their spouse and children residing at the owner's home address. Any privilege as a resident extended pursuant to this chapter is solely for the owner's benefit and may not be transferred. If the owner is a corporation or other legal entity, said privilege shall go to the controlling or majority stockholder or managing member. If ownership is vested in two (2) or more partners, said partnership shall notify the village clerk by December 1 of each year of the partner to be entitled to the resident status as set forth in this chapter for the preceding year. Said notification must include a notarized statement signed by all members of the partnership. Failure to notify the village clerk under this section shall disqualify the commercial non-resident taxpayer for the preceding year from any benefit authorized under this chapter.
(c) 
All commercial non-resident tax payers and non-resident owners of residential property as defined by subsection 24-3(c) above, shall be entitled to apply for one (1) resident identification card, which shall be valid for time period established by resolution of the village board to use all village facilities and services, including, but not limited to:
(1) 
Community center;
(2) 
Marina;
(3) 
"HoHum" and "Mothers" beaches;
(4) 
Golf course;
(5) 
Tennis courts;
(6) 
Ferry;
(7) 
Launch ramp;
(8) 
Parks;
(9) 
Various community programs; and
(10) 
Children's programs, including the children's camp.

Active fire and ambulance personnel from Bellport Fire District and South Country Ambulance District shall be permitted to use the golf course and shall be charged at resident rates. Such personnel must present valid identification from the respective district in the same manner as a resident identification card.
