The words, terms and phrases, when used in this article shall have the meanings set forth in this section, except where the context clearly indicates a different meaning:
means the building official of the city or any person designated by the city manager to administer the provisions of this article.
means any crime involving dishonesty, fraud, deceit, misrepresentation, or deliberate violence, or an act of baseness, vileness, or shameless conduct that shows a moral indifference to the social duties which an individual owes to his or her community.
means the Texas Department of State Health Services.
means the person or entity licensed by the State of Texas through the Texas Department of State Health Services to operate a massage establishment. The term "licensee" shall also include operator.
means a place of business that advertises or offers massage therapy or other massage services as defined herein and is licensed by the state of Texas in accordance with Chapter 455 of the Texas Occupations Code, and Title 25 of the Texas Administrator, as amended, including establishments variously known as massage parlors, and similar derivations. This term does not include beauty parlors or barber shops duly licensed by the state, or licensed hospitals, medical clinics, or licensed physical therapy facilities.
means a person who practices or administers massage therapy or other massage services to a client for compensation. The term includes a licensed massage therapist, therapeutic massage practitioner, massage technician, masseur, masseuse, myotherapist, body massager, or any derivation of those titles.
means the manipulation of soft tissue by hand or through a mechanical or electrical apparatus for the purpose of body massage and includes effleurage (stroking), petrissage (kneading), tapotement (percussion), compression, vibration, friction, nerve strokes, and Swedish gymnastics. The terms "massage," "therapeutic massage," "massage technology," "myotherapy," "body massage," "body rub," or any derivation of those terms are synonyms for "massage therapy."
include any services offered or performed for compensation at a massage establishment that involve physical contact with a client, and may include the use of oil, salt glow, a heat lamp, a hot and cold pack.
means body areas defined as including all genital organs, sex organs, and private parts of the human body and shall include, but not be limited to, the male and female genital areas, female breasts, and the area of the human buttocks.
