This article shall be known as the "Gas Code of the City of North Richland Hills, Texas," and may be cited as such.

The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Certain appliances
means conversion burners, floor furnaces, central heating plants, vented wall furnaces, water heaters and boilers.
Certificate of approval
means a document or tag issued or attached by the gas inspector to the inspected material, piping or appliance installation, filled out with the date and address of the premises, and signed by the inspector.
Gas company
means any person distributing gas within the corporate limits of the city, or authorized and proposing to so engage.
Inspector
means the person appointed as gas inspector, and shall include each assistant inspector, if any, from time to time acting as such under this article.
Person
means any individual, partnership, firm, corporation or any other organized group of individuals.

The purpose of this article is to provide minimum standards, provisions and requirements for the safe installation of consumer gas piping and gas appliances.

The International Fuel Gas Code, 2024 edition, as adopted by the International Code Council, Inc., a copy of which is on file in the office of the City Secretary, as amended by the recommended amendments of the North Central Texas Council of Governments, as modified by the city technical code committee, a copy of which is also on file in the office of the City Secretary, is hereby adopted by reference and designated as the fuel gas code of the city, the same as though such code were copied at length herein.

The chief building official, as provided for under the building code, and such assistants as may be deemed necessary to properly perform the duties of that office, shall provide the administration and enforcement of this article.

This article shall apply to all piping, fixtures, fittings or appliances installed, constructed, erected, altered, or added to or built upon and within the boundaries of the city if same are to be connected to either the city water or sewer systems, except those for which permits have already been issued by the building official prior to the passage of this section.

Nothing contained in this article shall be construed as prohibiting an individual from installing or repairing his own appliances, or installing, extending, replacing, altering or repairing consumer piping on his own premises, or as requiring a license or bond from an individual doing such work on his own premises; provided, however, that all such work must be done in conformity with all other provisions of this article, including those relating to permits, inspections and fees.

This article is not meant to apply to that work done by the proper employees of the city or other companies furnishing water in the laying of water mains and services and city sewer mains and services, or to the installation of gas distributing mains and services in the streets and alleys by employees of the gas distributing company, or any work performed by such gas distributing company on any piping or connection up to and including the outlet connections of the service meter. Nothing in this article shall be construed as prohibiting an individual from negotiating with the gas company for the repairs, replacements, or installation of yard or service lines (that line carrying the unmeasured gas) on his premises or as requiring a license or bond from the gas company. Such work shall be performed by qualified employees of the gas company in accordance with all state and federal regulations.

No person shall install a gas conversion burner, floor furnace, central heating plant, vented wall furnace, water heater, boiler or consumer gas piping, or convert existing piping to utilize natural gas, without first obtaining a permit to do such work from the building official, provided that the gas company shall not be required to obtain permits to set meters, or to extend, relocate, remove or repair its service lines, mains or other facilities, or for work having to do with its own gas system.

The gas inspector is authorized to disconnect any gas piping, fixture or appliance for which a certificate of approval is required but has not been issued with respect thereto, or which, upon inspection, shall be found defective or in such condition as to endanger life or property. In all cases where such a disconnection is made, a notice shall be attached to the piping, fixture or appliance disconnected by the inspector, which notice shall state that the same has been disconnected by the inspector, together with the reason or reasons therefor; and it shall be unlawful for any person to remove such notice or reconnect such piping, fixture or appliance without authorization by the inspector. Such gas piping, fixture or appliance shall not be put in service or used until the inspector has attached his certificate of approval in lieu of his prior disconnection notice.

The gas inspector shall issue a certificate of approval at the completion of the work for which a permit for consumer piping has been issued if it is found that such work complies with the provisions of this article. The inspector shall then notify the gas company authorizing the rendering of gas service.

This article shall not be construed as imposing upon the city any liability or responsibility for damages to any person injured by any defect in any gas piping or appliance mentioned herein, or by installation thereof, nor shall the city or any official or employee thereof be held as assuming any such liability or responsibility by reason of the inspection authorized under this article or the certificate of approval issued by the gas inspector.
