A. 
Any person or firm, prior to making any installation which requires the breaking of pavement or bituminous surfacing of any public street or alley within the corporate limits of the City, shall pay a seventy-five-dollar ($75.00) fee for each street or curb cut and make a deposit in the office of the City Clerk in the minimum amount of one thousand dollars ($1,000.00).
B. 
Any person or firm, having made such deposit, shall be refunded the full amount of the deposit only upon repair of the street cut with the same materials as was disrupted, providing the repairs are made in accordance with the Code and inspected by the Public Works Director or his/her designee within sixty (60) days of the deposit.
C. 
In lieu of or in addition to the requirements set forth in Subsection (A) of this Section, the City Administrator or his/her designee is authorized to:
1. 
Waive the seventy-five-dollar ($75.00) fee.
2. 
For large-scale or high-risk construction, require evidence of commercial liability insurance in amounts up to the current sovereign immunity limits for Missouri public entities and/or a cash bond or performance bond in amounts sufficient to guarantee the restoration of public rights-of-way. The contractor or utility owner may be required to name the City as an additional insured party.
3. 
Negotiate and charge other public utilities a unit price fee for City crews to complete asphalt surface repairs.
