No person shall consume, use, smoke, vape, aerosolize, imbibe any cannabis products in or upon any private vehicle while the vehicle is in motion or parked upon any such public or quasi-public place.
No person shall smoke, vape, or aerosolize cannabis items in any place that any other law prohibits the smoking of tobacco, including N.J.S.A. 2C:33-13 and the "New Jersey Smoke-Free Air Act." (N.J.S.A. 26:3D-55 et seq.).
A. 
No person shall sell, transfer, give or otherwise provide cannabis (in any form or substance) in the Borough of Haledon without a state license and a Borough permit(s), or otherwise allowable by statute or regulation duly adopted by the New Jersey Legislature or Cannabis Regulatory Commission.
B. 
Under no circumstance shall any business, including any properly licensed and approved cannabis business or cannabis license holder under any class of license, engage in gifting cannabis. "Gifting" or "gift" means transferring any amount of cannabis for promotional or business purposes occurring outside of a cannabis sales transaction.
It shall be deemed a nuisance, if a person who is consuming, using, smoking, vaping, aerosolizing or imbibing cannabis shall permit excessive odor or other pollution to extend beyond the person's premises.
Any business, including any properly licensed and approved cannabis business or cannabis license holder found in violation of this provision shall be subject to fines, violations and penalties, and when appropriate criminal prosecution. Fines for a violation of this chapter for smoking of cannabis shall be not less than $150 and no more than $500 per occurrence. Fines for violation of this chapter for gifting of cannabis or medical marijuana shall be not less than $500 and no more than $1,500 per occurrence.
