DUMPSTER
A container or debris-transfer body commonly used for the placing and/or collection of debris and building materials during construction and/or renovations which, for the purposes of this chapter, shall include movable storage units containing refuse or debris.
STORAGE UNIT, TEMPORARY
Any temporary structure or container unit designed for the temporary outdoor storage of personal property, including any temporary garage or other structure used for storage that does not require a certificate of occupancy under the construction codes. This definition specifically includes portable on-demand storage structures (PODS) or similar storage containers, which are typically rented to owners or occupants of property for their temporary use and which are delivered and removed by vehicle.
A. 
No dumpster or temporary storage unit shall be placed or maintained by any private person or entity in or on any Township property, street or right-of-way.
B. 
No dumpster or temporary storage unit shall be placed or maintained by any private person or entity within a residential zone without a valid permit issued by the Zoning Officer.
C. 
This provision does not apply to any approved industrial or commercial use that was the subject of an approved site plan.
A. 
The application for a permit shall be accompanied by a permit fee of $5 made payable to the Borough of Bloomsbury on a form provided by the Borough.
B. 
No permit shall be granted by the Zoning Officer for a term longer than seven days. A permittee may request an extension of the seven-day time period from the Zoning Officer by filing a subsequent permit application accompanied by the permit fee of $10. At no time shall the dumpster or temporary storage unit be in place for a time period in excess of 14 days (i.e., original seven days plus one extension).
C. 
Upon the expiration of the permit, the permit holder shall remove or cause to be removed the dumpster or temporary storage unit from the property.
D. 
There shall be a limit of one dumpster or temporary storage unit for each permit application.
E. 
There shall be a limit of one permit plus extension per property issued during a single calendar year.
A. 
No dumpster or temporary storage unit shall be placed within 10 feet of a fire hydrant.
B. 
No dumpster or temporary storage unit shall be placed within a municipal right-of-way or to block pedestrian traffic on a sidewalk.
C. 
No dumpster or temporary storage unit shall be placed within five feet of an adjacent property owner's driveway.
D. 
The dumpster or temporary storage unit similar container shall not be filled higher than four inches from the top edge to prevent debris or materials from falling or being blown onto the streets.
E. 
No hazardous material or organic waste shall be placed in a dumpster or temporary storage unit.
F. 
A dumpster or temporary storage unit shall be no larger than 99 square feet in area and no higher than 10 feet above grade.
A. 
It shall be unlawful for a dumpster or temporary storage unit to remain on any property in excess of the time period set forth in the permit used by the Borough. Each day a dumpster or temporary storage unit remains on a property in violation of the provisions of this chapter shall be considered a separate violation subject to the penalty provisions set forth below.
B. 
Any person who violates any provision of this chapter shall, upon conviction thereof, be subject to the penalty provisions of Chapter 1, General Provisions, Article I, General Penalty, of the Code of the Borough of Bloomsbury.
