At the discretion of the Chief of Police, no person under the age of 18 years shall remain in or upon the public streets, highways, roads, parks, playgrounds or other public grounds, public places or public buildings between the hours of 9:00 p.m. and 1/2 hour after sunrise at the prevailing local time on October 30 and 31 of each year. Failure to leave after warning by a police officer of the Borough of Park Ridge shall constitute violation of this article in accordance with punishment set forth at length herein.
A person shall not be considered in violation of this article:
A.
When accompanied by a parent, guardian or adult having legal care and custody of such minor.
B.
When the minor is on an emergency errand directed by his or her parent or guardian or other adult having legal care and custody of such minor.
C.
When the minor is en route to or returning directly home from school, a meeting, entertainment, recreational activity, dance, employment, religious ceremony or any other lawful activity.
In the event of an outbreak of, or threat of an imminent outbreak of, violence or acts of vandalism or injury, damage to persons or property committed by persons under the age of 18 years, the Mayor may declare a state of emergency and impose a curfew for persons under the age of 18 years of age. Such curfew shall not exceed a consecutive period of 72 hours and shall be subject to the exceptions set forth in § 78-8 hereof. Such curfew shall be applicable to all places set forth in § 78-7 hereof. Failure to leave after warning by a police officer of the Borough of Park Ridge shall constitute a violation of this article, subject to the penalties provided.
Any person who violates any provision of this article shall be subject to treatment as a juvenile delinquent in need of supervision pursuant to N.J.S.A. 2A:4-42 et seq. and the rules of the court pertaining thereto. Any juvenile who reaches the age of 18 years, while an offense under this article is pending, shall be subject to prosecution hereunder in the Municipal Court and, upon conviction, by punishment as provided by the statutes of the State of New Jersey and the Code of the Borough of Park Ridge.
Whenever any minor under the age of 18 years is arrested for violation of § 78-7 of this article, the Chief of Police shall notify the parent, guardian or other person having custody of such minor of such arrest.
Any person who violates any provisions of this article shall, upon conviction thereof, be punished by a fine not exceeding $2,000, or by imprisonment for a term not exceeding 90 days, or both. Any such violation shall constitute a separate offense on each successive day continued.
