MOBILE FOOD TRUCK
An enclosed motor vehicle containing equipment and facilities, including but not limited to cookers, grills, smokers, stoves, ovens, or similar equipment, intended to be used for the storage, preparation, and sale of food products and/or beverages.
MOBILE FOOD VENDING UNIT
Any freestanding pushcart, wagon, or vehicle other than a mobile food truck, that may be moved either manually or with assistance of a motor, that is intended to be used for the storage, preparation, and sale of food products and/or beverages.
MOBILE RETAIL FOOD BUSINESS
Either a "mobile food truck," or a "mobile food vending unit" as defined herein.
MOBILE RETAIL PRE-PACKAGED FOOD BUSINESS
A food establishment that is located on a vehicle where pre-packaged food or beverage is stored and served in individual portions, and no cooking or other preparation of food or beverage is conducted on or within the vehicle.
A. 
No person or business shall engage in or carry on the business of operating a mobile retail food business on public property without first obtaining a license from the City of Pleasantville as provided in this article.
B. 
Requirements for licensure.
(1) 
All applicants for a license to operate a mobile retail food business must obtain or show proof of an existing mercantile license from the City of Pleasantville in accordance with Chapter 155 of the City Code.
(2) 
All applicants for a mobile retail food business license must show proof of a valid certification or approval from the Atlantic County Division of Public Health to operate a mobile retail food establishment in accordance with N.J.A.C. 8:24-9.1.
(3) 
All applicants for a mobile retail food business must have a valid permit from the City of Pleasantville Fire Department, Fire Prevention Bureau demonstrating compliance with all technical fire safety requirements.
(4) 
Proof of public liability insurance for the vehicle to be used as a mobile retail food business must be provided.
C. 
A license to operate a mobile retail food business on public property shall be valid only during the calendar year during which the license is issued.
D. 
The maximum number of mobile retail food business licenses to operate on public property that shall be issued by the City of Pleasantville in any one calendar year shall be as follows:
(1) 
Daily permit: five per day.
(2) 
Weekly permit: five per week.
(3) 
Annual/seasonal permit: eight per year/season.
E. 
A license to operate a mobile retail food business on public property shall not be transferable to any third party and shall be used only by the licensed operator and as described in the application.
F. 
All licenses to operate a mobile retail food business on public property shall be conspicuously displayed on the premises of the mobile retail food business, or be available for inspection upon request at all times that the business is in operation.
G. 
The application fee to obtain a license to operate a mobile retail food business on public property shall be $50.
All mobile retail food businesses shall be required to obtain a parking permit from the City of Pleasantville in order to park their vehicle on public property. The fees for obtaining a parking permit to operate a mobile retail food business in the City of Pleasantville shall be as follows:
A. 
Daily permit: $50 per day.
B. 
Weekly permit: $300 per week (Monday through Sunday).
C. 
Annual/Seasonal permit: $3,000 per year/season.
D. 
Any mobile retail food business that will be owned or operated by a veteran who served the United States in the active military, naval, air, or space service, and who was discharged or released therefrom under conditions other than dishonorable, shall be eligible for a reduction of the fees identified above by 10%.
No person or business shall engage in or carry on the business of operating a mobile retail food business on public property owned by the City of Pleasantville except for the following locations:
A. 
Marina Bay Parking Lot (Block 446, Lot 1), no more than six mobile retail food businesses shall be permitted to operate on the premises on any given day unless otherwise permitted by act of the City Council.
B. 
Lakes Bay Waterfront Unity Park (Block 258, Lot 3.01), no more than three mobile retail food businesses shall be permitted to operate on the premises on any given day unless otherwise permitted by an act of the City Council.
C. 
In the Central Business District, no more than two (4)[??] mobile retail food businesses shall be permitted to occupy on-street parking spaces on either Old Turnpike or West Jersey Avenue, between Main Street and South Franklin Boulevard where parking is permitted, unless otherwise permitted by an act of the City Council.
A. 
Mobile retail food businesses shall be permitted to operate on the above listed public properties from April 1 through October 31 each year and in accordance with the dates of their parking permit. This term shall be considered the operating season. No mobile retail food businesses shall be permitted to operate on public property outside of this operating season.
B. 
Hours of operation for any mobile retail food business shall be limited to 8:00 a.m. to 9:00 p.m., to serve food to the public, with one hour grace period provided prior to and after these hours of operation to allow for setting up and cleaning up of the premises.
C. 
Mobile retail food businesses shall be located on either a public street or within a public parking lot. No stopping or standing of a mobile retail food business vehicle shall be permitted on a public sidewalk.
D. 
Mobile retail food businesses shall not locate on public property in any manner that would obstruct the free flow of pedestrian or vehicular traffic.
E. 
All mobile retail food businesses shall be responsible for maintaining a clean environment, and shall be responsible for collecting and disposing of all garbage and recyclable materials generated by their operation on a daily basis.
F. 
Suitably sized garbage and recycling receptacles must be placed within 10 feet of the mobile retail food business for use of patrons of the business.
G. 
A mobile retail food business may provide outdoor seating for patrons provided that such seating does not otherwise obstruct the free flow of pedestrian or vehicular traffic.
H. 
Any propane tanks, natural gas tanks, or generators used for cooking foods shall be shut off while the mobile retail food business vehicle is in motion.
I. 
Any vehicle used as a mobile retail food business shall have a maximum vehicle length of 35 feet.
J. 
Any mobile retail food business that will utilize a power generator shall be required to abide by all applicable state and county noise requirements.
K. 
Mobile retail food businesses shall not be stored on City property overnight. All mobile retail food business vehicles shall vacate the premises on which they are otherwise permitted to operate by 10:00 p.m.
L. 
No mobile retail food business shall dump ice, grease, grey water, or other refuse liquids onto City streets. All materials shall be disposed of properly in accordance with all applicable County health codes.
M. 
Any mobile retail food business found to be operating in violation of this article shall be issued a citation with a fine of a minimum of $500 and up to $1,000 per violation.
N. 
Any mobile retail food business found to be in violation of this article more than two times in any calendar year may be subject to revocation of its license by the City by City's zoning official.
O. 
The City reserves the right to suspend the use of City property for operations by all mobile retail food businesses in the event of emergency or scheduled special events that require the use of public property for other purposes. For any scheduled special events, the City shall notify all licensees of the suspension at least 10 days in advance.
A mobile retail pre-packaged food business shall be exempt from the requirements of this chapter provided that such business does not stop or stand on any single location on public property for a duration of longer than 15 minutes at a time.
