As used in this chapter, the following terms shall have the meanings indicated:
BILLBOARD
A sign, including the type commonly known as a "billboard," which directs attention to a business, commodity, service, entertainment or attraction sold, offered or existing elsewhere than upon the same lot where such sign is displayed or only incidentally upon such lot.
SIGN
Any letter, word, model, banner, pennant, insignia, trade flag, device or representation used as, or which is in the nature of, an advertisement, attraction or directive.
SIGN AREA
Shall include all faces of a sign measured as follows:
A. 
When such sign is on a plate or framed or outlined, all of the area of such plate or the area enclosed by such frame or outline shall be included.
B. 
When such sign consists only of letters, designs or figures engraved, painted, projected or in any manner affixed on a wall, the total area of such sign shall be deemed the area within which all of the matter of which such sign consists may be inscribed.

No sign, billboard or advertising display or structure, poster or device shall be erected, moved, enlarged or reconstructed except as expressly permitted in the Code of the Village of North Haven. No sign may be placed within any Village right-of-way or upon any Village property.
The following types of signs or artificial lighting are prohibited:
A. 
Billboards.
B. 
Flashing signs, including any sign or device on which the artificial light is not maintained stationary and constant in intensity and color at all times when in use.
C. 
Signs which project more than one-foot over a street.
D. 
Signs which compete for attention with, or may be mistaken for, a traffic signal.
E. 
The outlining by direct illumination of all or any part of a building such as a gable, roof, side, wall or corner.
F. 
Representational signs designed so as to physically represent in two or three dimensions the object advertised.
G. 
Signs made of cardboard, paper, canvas or similar impermanent material.
H. 
Construction signs which are signs identifying a contractor, architect, materialman, lender or other entity involved with a project on the property where the sign would be located.

Subject to the provisions of this chapter, the following signs are permitted on any premises in the Village:
A. 
One nonilluminated nameplate or professional sign with an area of not over two square feet.
B. 
Real estate signs.
(1) 
One temporary nonilluminated sign advertising the sale or rental of the premises on which such sign is situated, with an area of not over four square feet, provided that such sign is located on the front wall of a building or, if freestanding, then not nearer than 25 feet to any street line and 15 feet to any other property line.
(2) 
Real estate signs shall be removed forthwith upon completion of the transaction advertised.
C. 
Subdivision signs.
(1) 
One nonilluminated, freestanding sign identifying the name of a subdivision in the Village of North Haven, with an area not exceeding 10 square feet. A building permit shall be obtained prior to the construction of any subdivision sign.
(2) 
Such subdivision sign shall be located at least 25 feet from any street line and 15 feet from any other property line.
D. 
Political signs limited in size to four square feet, displayed on private property, may be displayed one month prior to an election and removed within two days post-election.

Any person committing an offense against any provision of this chapter shall, upon conviction thereof, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this chapter shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
