The purpose of this article is to protect the public health, safety, and welfare by regulating the operation of vehicles on public sidewalks.

Bicycle.
For the purposes of this section, bicycle shall have the meaning assigned by section 541.201 of the Texas Transportation Code.
Electric bicycle.
For the purposes of this section, electric bicycle shall have the meaning assigned by section 541.201 of the Texas Transportation Code.
Electric personal assistive mobility device.
For the purposes of this section, electric personal assistive mobility device shall have the meaning assigned by section 551.201 of the Texas Transportation Code.
Golf cart.
For the purposes of this section, golf cart shall have the meaning assigned by section 18.04.072, definitions.
Moped.
For the purposes of this section, moped shall have the meaning assigned by section 541.201 of the Texas Transportation Code.
Motor assisted scooter.
For the purposes of this section, motor assisted scooter shall have the meaning assigned by section 551.351 of the Texas Transportation Code.
Motor vehicle.
For the purposes of this section, motor vehicle shall have the meaning assigned by section 541.201 of the Texas Transportation Code.
Neighborhood electric vehicle.
For the purposes of this section, neighborhood electric vehicle shall have the meaning assigned by section 18.04.072, definitions.
Off-highway vehicle.
For the purposes of this section, neighborhood electric vehicle shall have the meaning assigned by section 18.04.072, definitions.
Pocket bike (or minimotorbike).
For the purposes of this section, pocket bike shall have the meaning assigned by section 551.351 of the Texas Transportation Code.
Sidewalk.
For the purposes of this section, sidewalk shall have the meaning assigned by section 1.01.004, definitions and rules construction.
Vehicle.
For the purposes of this section, vehicle shall have the meaning assigned by section 541.201 of the Texas Transportation Code.

The use of sidewalks within the corporate limits of the city is authorized under the following conditions:
(1) 
The following may use a sidewalk at any time when a sidewalk is available:
(A) 
Pedestrians.
(B) 
Bicycles.
(C) 
Electric bicycles.
(D) 
Electric personal assistive mobility devices.
(2) 
Subsection (1) does not prohibit the operation of a motor vehicle on a sidewalk connection with maintenance or an emergency.

The following is a non-exhaustive list of vehicles that may not generally operate upon a sidewalk:
(1) 
Electric motorcycle or electric motor bike.
(2) 
Golf cart.
(3) 
Moped.
(4) 
Motor assisted scooter.
(5) 
Motor vehicle.
(6) 
Motorcycle.
(7) 
Neighborhood electric vehicle.
(8) 
Off-highway vehicle.
(9) 
Pocket bike (minimotorbike).

(a) 
It shall be unlawful for any person to operate a vehicle identified in this article on public sidewalks within the corporate limits of the city except in accordance with the provisions of this article.
(b) 
Any person who shall violate the provisions of this division shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined not less than $1.00 or more than $500.00. It shall not be necessary for the complaint to allege or for proof to be made that the act was knowingly done, or with any other culpable mental state, nor shall it be necessary for the complaint to negate any exception contained in this article.
