The City Council finds and declares that:
A. 
Unregulated firearms, particularly those manufactured through non-traditional methods, including three-dimensional printing and additive manufacturing, present a unique and escalating threat to public safety due to the potential lack of serial numbers, which undermines traceability and accountability.
B. 
The purpose of this chapter is to address public safety concerns by limiting the creation, transfer, and accessibility of untraceable and non-serialized firearms, thereby enhancing community safety and supporting law enforcement efforts to reduce crime.
C. 
The City aims to reduce the proliferation of so-called "ghost guns" and other unregulated firearms that evade established licensing and regulatory frameworks.
ADDITIVE MANUFACTURING
A manufacturing process in which material is laid down successively to produce the product, including but not limited to three-dimensional printing.
FEDERAL FIREARMS LICENSEE
A person licensed by the Bureau of Alcohol, Tobacco, Firearms and Explosives to engage in the business of manufacturing, importing, or dealing of firearms.
FINISHED FRAME OR RECEIVER
Any frame or receiver that requires no additional milling or modification to be capable of expelling a projectile when combined with additional components such as a barrel
FIREARM
Any item classified as a firearm as defined in 18 Pa. C.S.A. § 6120(b).
FIREARM FINISHING DEVICE
Any device, such as a firearm finishing mill or jig, primarily designed to aid in converting an unfinished frame or receiver into a finished frame or receiver.
FIREARM FINISHING JIG
A jig designed to aid in converting an unfinished frame or receiver into a finished frame or receiver.
FIREARM FINISHING MILL
Any computer numerical control mill or other automated 79 device designed to aid in converting an unfinished frame or receiver into a finished frame 80 or receiver.
REGULATED ITEMS
Unfinished frames or receivers and firearm finishing devices.
THREE-DIMENSIONAL PRINTER
A computer-driven machine capable of producing a three-dimensional object from a digital model or program.
UNFINISHED FRAME OR RECEIVER
A piece of any material that does not yet constitute a firearm, but that has been shaped or formed in any way for the purpose of becoming the frame or receiver of a firearm.
A. 
No person, unless licensed to manufacture firearms under federal law, shall:
(1) 
Use a three-dimensional printer to create any firearm, or any component part thereof or attachment thereto;
(2) 
Use any additive manufacturing process to produce a firearm; or
(3) 
Convert an unfinished frame or receiver into a finished firearm.
B. 
No person shall sell or otherwise transfer a firearm finishing device or an unfinished frame or receiver unless both the transferor and transferee are federal firearms licensees.
C. 
No person shall purchase or accept transfer of a firearm finishing device or an unfinished frame or receiver unless both the transferor and transferee are federal firearms licensees.
Nothing in this chapter is intended or shall be construed to supplant, alter, or otherwise assert authority preserved to the Commonwealth of Pennsylvania or the federal government.
Any person who violates the provisions of this chapter shall be subject to Chapter 3-399, Penalty, of these Codified Ordinances.
