Atlantic City, NJ Chapter 216A Shopping Carts and Unattended Luggage and Bags

§ 216A-1 Shopping carts prohibited on Boardwalk and in public parks.

A. It shall be unlawful for any person to bring, possess, or use a shopping cart on the Atlantic City Boardwalk or in any public park within the City limits.

B. Any shopping cart found on the Boardwalk or in a public park shall be subject to immediate removal and confiscation by the City or its authorized agents.

§ 216A-2 Unattended luggage, backpacks, and containers on Boardwalk or in public parks prohibited.

A. No person shall leave unattended any luggage, backpack, container, or similar personal property on the Boardwalk or in any public park.

B. Any unattended item found in these areas shall be considered abandoned and subject to immediate removal and confiscation by the City or its authorized agents.

C. Confiscated items shall be deemed abandoned, after which they may be disposed of.

§ 216A-3 Exemptions.

This chapter shall not apply to:

A. Official City maintenance or law enforcement personnel in the performance of their duties.

B. Individuals using wheeled assistive devices for mobility assistance.

C. Authorized vendors or businesses with a valid permit issued by the City.

§ 216A-4 Enforcement; violations and penalties.

A. The Atlantic City Police Department, Code Enforcement Officers, and other designated City personnel shall have the authority to enforce this chapter.

B. Any person found in violation of this chapter shall be subject to a fine not exceeding $250 for a first offense, $500 for a second offense, and $1,000 for each subsequent offense.

C. Repeat violators may be subject to additional penalties, including, but not limited to, community service or a ban from City parks and the Boardwalk, as determined by the City.

§ 216A-5 Severability.

If any provision of this chapter is found to be invalid or unenforceable by a court of competent jurisdiction, the remainder of this chapter shall remain in full force and effect.

§ 216A-6 When effective.

This chapter shall take effect immediately upon final passage and publication as required by law.
