§ 425-10 Maximum speed limits established on certain streets.

Maximum speed limits are established on portions of specified streets, as follows, and it shall be unlawful for any person to drive a vehicle, on any part of a street where a maximum speed limit applies, at a higher speed than the maximum prescribed for that part of the street:

Any person who violates any provision of this section shall, upon conviction, be sentenced to pay a fine of $50 and costs. Any person exceeding the maximum speed limit by more than five miles per hour shall pay an additional fine of $5 per mile for each mile in excess of five miles per hour over the maximum speed limit.

(1)

Enforcement and penalties. Any person convicted of a violation of any of the provisions of Ord. No. 2025-03 shall be sentenced to pay those fines and costs established by the applicable provisions of the Vehicle Code or any subsequent act of the General Assembly which amends said Vehicle Code.[1] Disposition of said fine or fines shall be made in accordance with the provisions of the Vehicle Code.

The maximum speed limit established under Ord. No. 2025-03 shall be posted on official traffic control devices erected in accordance with regulations adopted by the Pennsylvania Department of Transportation of the Commonwealth or any successor agency.

§ 425-11 Traffic signals at certain locations.

At the following locations, traffic signals as indicated below shall be erected (or are ratified if previously erected), and traffic at those locations shall be directed by those signals:

Any driver of a vehicle who disobeys the directions of any traffic signal, shall, upon conviction, be sentenced to pay a fine of $50 and costs.

§ 425-12 Right turn prohibited on red.

All intersections within the Borough which are regulated by a traffic signal are established as intersections where drivers of vehicles headed in the direction or directions indicated are prohibited from making a right turn on a steady red signal.

Any driver of a vehicle who violates any provision of this section shall, upon conviction, be sentenced to pay a fine of $50 and costs.

§ 425-13 No passing zones established.

All streets within the Borough boundaries are established as no passing zones, and it shall be unlawful for the driver of any vehicle to overtake or pass another vehicle or to drive on the left side of the roadway.

Any person who violates any provision of this section shall, upon conviction, be sentenced to pay a fine of $50 and costs.

§ 425-14 Through highways established.

The following highways are established as through highways, thus authorizing stop or yield signs to be erected facing traffic approaching every intersection with the through highway except for those intersections with traffic signals, or with exceptions or modifications as indicated below. Every driver of a vehicle approaching a stop or yield sign authorized by this section shall stop the vehicle or yield right-of-way as required by Section 3323(b) or (c) of the Vehicle Code,[1] as the case may be, and shall not proceed into or across the through highway until he has followed all applicable requirements of that section of the law:

§ 425-15 Stop intersections established.

The following intersections are established as 4-Way Stop Intersections, and official stop signs shall be erected (or are ratified if previously erected) in such a position as to face traffic approaching each of the named streets. Every driver of a vehicle approaching the intersection shall stop the vehicle as required by Section 3323(b) of the Vehicle Code[1] and shall not proceed into or across the intersection until he has followed all applicable requirements of that section of the law.

The following intersections (in addition to intersections with the through highways established in § 425-14) are established as stop intersections, and official stop signs shall be erected (or are ratified if previously erected) in such a position as to face traffic approaching the second-named street (the intersecting or through street) on the first-named street (the stop street) in the direction or directions indicated for that intersection. Every driver of a vehicle approaching the intersection on the first named or stop street, in the direction indicated in each case, shall stop the vehicle as required by Section 3323(b) of the Vehicle Code,[3] and shall not proceed into or across the second-named or intersecting or through street until he has followed all applicable requirements of that section of the law.

§ 425-16 Skates, coasters, sleds and other toy vehicles.

It shall be unlawful for any person to ride on a sled upon any sidewalk in the Borough, or upon any roadway unless that roadway is on a portion of a street blocked off for sledding by authority of § 425-5 of Article I of this chapter. Provided: nothing in this subsection shall prevent a pedestrian from pulling a sled, with or without a rider, upon a sidewalk.

It shall be unlawful for any person to engage in rollerskating or skateboarding or to ride upon or propel any coaster or other toy vehicle upon:

(1)

Any street except in order to cross the roadway; or

(2)

Any sidewalk located in a business district.

Any person who violates any provision of this section shall, upon conviction, be sentenced to pay a fine of $15 and costs.

§ 425-17 Regulations of non-motorized vehicles.

Definition.

As used in this section, the following terms shall have the meanings indicated:

NON-MOTORIZED VEHICLE

A vehicle or manufactured form of transportation or recreation that employs the use of wheels or rollers to enable the user to move; including but not limited to bicycles, scooters, skateboards, in-line skates, roller skates, or long-boards.

Private property; permission required. Non-motorized vehicles shall not be operated on private property unless permission from the owner or person in control of the premises is obtained prior to such use.

Control devices and regulations: right-of-way to pedestrians and motor vehicles. Any person operating a non-motorized vehicle shall:

(1)

Obey the instruction of a police officer or other appropriately attired or authorized person to direct, control or regulate traffic;

(2)

Obey traffic and pedestrian control signals as provided under any Pennsylvania Motor Vehicle Section, including, but not limited to, § 3112 (relating to traffic control signals) and § 3111 (relating to pedestrian control signals),[1] or any Borough ordinance or resolution;

(3)

Yield the right-of-way to any pedestrian and shall not overtake or pass a pedestrian without giving audible warning;

(4)

Not suddenly leave a curb, sidewalk, berm or street or any other place to ride or drive into, along side of or toward the path of a vehicle, which is so close as to constitute a hazard or cause alarm;

(5)

Not place a ramp, half-pipe or other structure in or about any thoroughfare, street, sidewalk, parking lot or Borough property;

(6)

Not operate a non-motorized vehicle in the public right-of-way in such a manner as to endanger or interfere with the passage or safety of other users;

(7)

Not operate a non-motorized vehicle in the public areas, municipal parks or properties, or in other areas regularly used by members of the public, such as but not limited to parking lots, in such a manner as to endanger or interfere with the passage or safety of other users;

(8)

Not operate a non-motorized vehicle in such a manner as to cause damage, however slight, to or destruction of public property; and

(9)

Not operate a non-motorized vehicle between dusk and dawn without lights or sufficient lighting to be clearly visible to pedestrians, motor vehicles or other users of public right-of-ways.

Violations and penalties.

(1)

First offense. Any item used in violation of this section shall be impounded by the Borough Police Department for a period not exceeding 30 days. If the person violating the section is a minor, in addition to the confiscation of the item, the Borough Police shall notify the parents, guardian or other person having legal custody of said minor of the violation of this section and the impounding and provide such individual with a copy of this section. Any person who violates this section shall, upon conviction, be sentenced to pay a maximum fine of $100, to make restitution for damage caused, and to perform up to five hours of community service within the Borough.

(2)

Second and/or subsequent offense. Any item used in a second or subsequent offense in violation of this section shall be impounded by the Borough Police Department for a period not exceeding 60 days. Any person who violates this section shall, upon conviction, be sentenced to pay a maximum fine of $500, to make restitution for damage caused, and to perform up to 10 hours of community service within the Borough.

Exception. This section shall not apply to any mobilization equipment, such as but not limited to wheelchairs or scooters, safely utilized by a person with any disability.

§ 425-18 Entry prohibited at certain times in certain locations.

Entry shall be prohibited at the following times in the following locations:

§ 425-19 Entry prohibited in certain locations.

§ 425-20 Entry restricted to local traffic only.

Entry shall be restricted to local traffic in the following locations:
