As used in this article, the following terms shall have the meanings indicated:
BARBEQUE
Shall include any device used for preparation of food, including but not limited to: charcoal, electric, or piped natural gas or propane barbecue devices, smokers or "green eggs" or similar devices.
EASEMENT
For this section, an easement is an interest in land owned by another person, consisting in the right to use or control the land, or an area above or below it, for a specific limited purpose. Specifically, this may be any area generally used by the public pedestrian that is at or near a public road, such as an unpaved sidewalk area.
EQUIPMENT and APPARATUS
Any item or items, whether permanent or mobile, that require for their use the congregation of one or more persons in and about the immediate area of the item or items. This definition is intended to include, but is not limited to, basketball hoops and hockey goals.
FIREPIT
A pit dug into the ground or encased in a surrounding structure (as of masonry or steel) in which a fire is kept burning for cooking, warmth, etc. This definition may include oil drums, steel drums or any other makeshift device that would be used for warmth or cooking food.
GOODS AND SERVICES
Any goods or services being sold on a public sidewalk, easement or thoroughfare without a Borough license or permit.
GRILL
A cooking utensil/vessel usually with parallel bars on which food is exposed to heat (as from gas, charcoal or electricity). See also "barbeque."
MOTORIZED VEHICLE
Any mode of transportation that operates by some kind of motorization, including but not limited to automobiles, motorcycles, motor scooters, electric bicycles, electric transportation devices, Segways or similar devices.

A. 
No equipment or apparatus shall be placed by any person in a public right-of-way or on private property in the vicinity of any public right-of-way such that the use of the equipment or apparatus would tend to require any user to be in and about the public right-of-way.
B. 
The use of a charcoal, electric, or piped natural gas or propane barbeque indoors, or on any commercial property, or on any sidewalk, right-of-way, thoroughfare, or street, is a violation of this section.
C. 
Parking or temporarily leaving any motorized vehicle, lawn chairs, planters, bicycles, or other object on a sidewalk, easement, right-of-way, street, or thoroughfare to impede safe and unimpeded pedestrian public use is a violation.
D. 
Any sales, solicitations, or unreasonable obstruction of a public sidewalk, easement, right-of-way or thoroughfare is prohibited.
E. 
Placement of any bench, fixture, planter or street furniture or unattended belongings on a street, sidewalk, easement, right-of-way or thoroughfare is prohibited.

A. 
Any person violating the above provision shall be subject to a warning for the first violation, a fine of $100 for the second violation and a fine not to exceed $500 for each subsequent offense.
B. 
There shall be a presumption that the person or persons who have violated this provision are those who control the private property on which the equipment or apparatus is situated, or if the equipment or apparatus is in a public right-of-way, those who control the private property closest to the equipment or apparatus.
