The following words, terms, and phrases when used in this Chapter shall have the meanings ascribed to them in this Section, except where the context clearly indicates a different meaning. Additional definitions pertaining to transportation network services, transportation network companies, and transportation network drivers are set forth in Article
IX of this Chapter.
CHANGE OF OWNERSHIPA. A change in the form of ownership, e.g., from an individual or partnership or entity or from a partnership to an individual;
B. A change from an individual to a partnership or a change in a partnership such as the addition or deletion of any partner; or
C. In an entity, the transfer of over 5% of the stock thereof except for those listed on a national stock exchange, in which event the transfer of a controlling interest or over 50% of the stock thereof.
CITY CLERKThe City Clerk of the City of Bloomington or their designee.
CITY MANAGERThe City Manager of the City of Bloomington or their designee.
DRIVERThe operator of a vehicle.
DRIVER'S PERMITThe permit granted to a person by the City Clerk to drive a vehicle for hire upon the streets of the City of Bloomington or Town of Normal.
ENTITYAn organization that has an identity separate from those of its members. Includes, but is not limited to, a person, corporations, not-for-profit corporations, limited partnerships, limited-liability companies, or limited-liability partnerships.
MANIFESTA daily record prepared by a vehicle for hire driver of all trips made by said driver showing time and place of origin, destination, number of passengers, and the amount of fare for each trip, with the exception that vehicles with a capacity of nine or more passengers do not have to keep a manifest.
METERAny mechanical, digital, or electronic device that records and indicates a charge or fare measured by distance traveled, waiting time, and extra passengers.
PERSONIncludes an individual, a corporation, limited-liability company, partnership, or other legal entity.
RATE CARDA card or sign required to be displayed in or on each vehicle for hire that details the rates of the fare then in force.
SEX OFFENDERAny person convicted, adjudicated, or otherwise found to be a sex offender as that term is defined in the Sex Offender Registration Act, 730 ILCS
150/2. Said term shall include any person found to have committed a sexual offense as described in said statute, regardless of whether that person is required to register as a sex offender in Illinois. Said term shall include convictions, adjudications, or findings of a violation of any substantially similar federal, Uniform Code of Military Justice, sister state, or foreign country law. This term shall not be construed so as to violate provisions of the Juvenile Court Act.
VEHICLE FOR HIREAny motor vehicle engaged in the business of carrying persons for hire on the streets of the City of Bloomington or Town of Normal, except excluded from coverage in §
40-101B, and not operated on a fixed route. Vehicles may include, but are not limited to, cars, trucks, vans, sport utility vehicles (SUV), taxicabs, shuttles, limousines, party buses, trolleys, and horse-drawn carriages. "Vehicle for hire" does not include Transportation Network Providers. All vehicles for hire carrying nine or more passengers shall be registered and classified by the State of Illinois as a commercial or public transportation vehicle.
WAITING TIMEA. The following may be considered chargeable wait times when a hired vehicle for hire is not in motion:
(1) Time commencing three minutes after arrival at the place to which the vehicle for hire has been summoned and ending with the passenger's entry into the vehicle;
(2) Time consumed by ordinary traffic delays;
(3) Time the vehicle for hire is not in motion due to the request, act, or fault of a passenger or passengers.
B. It shall not include:
(1) Time lost due to inefficiency of the vehicle or its driver;
(2) Time consumed by premature response to a call;
